Human Duties and Rights in an Intercultural Perspective

This paper reflects on the possibility of opening new ways of revaluing the role of human responsibilities and duties by establishing a relationship with rights that goes further than a simple correspondence between correlative terms. Approaching the interdependence between the language of rights and the language of duties from an intercultural perspective helps achieve an increasingly broader, but necessarily more complex, consensus. This analysis goes back to the Universal Declaration of Human Rights, which left duties in the background but showed the incipient presence of an intercultural purpose thanks to the work of UNESCO. In many continental legal systems it was often problematic to grant a security right to an entity separate from the holder(s) of the secured receivables. Such arrangement was especially desired by the parties in complex lending structures with many creditors. To solve this problem various legal solutions have been created in different countries. In Poland and in France the special institution of a security agent has been introduced. Aim of this article is to compare those two regulations. By paying attention to the complexities of the issue of sex trafficking in Europe, the paper critically analyzes the feminist debate on sex trafficking, articulated from the «abolitionist» and «sex workers’ rights» perspectives. The article examines the limits of the current feminist interpretations of sex trafficking developed around the «victimhood» versus «agency» dichotomy in relation to prostitution, and explores other possible spaces for a feminist critique of sex trafficking in Europe.
