Liberty and Equality as the Morality of the Rule of Law

After presenting a schematic map of the concepts at stake (liberty, equality) in so far as they are relevant for the general topic (their relationship with rule of law – from now on RoL), and after examining different forms of their relationships, this entry focuses on the specificity of the relationship between liberty and equality in the legal context. The title suggests that a combination of liberty and equality is the very basis of every legal system inspired by RoL. This circumstance requires the identification of different versions of the idea of RoL.

Usually, in jurisprudential debates what is discussed under the rubric of ‘neutrality’ is the claim that jurisprudence is (or at least can, and should be) a conceptual, or descriptive - thus, non-normative, or morally neutral - inquiry. I discuss neutrality in an altogether different sense, namely, neutrality as an ethico-political ideal the law should meet. My starting point is normative legal positivism, or the claim that it is a good and desirable thing that the laws have easily identifiable, readily accessible, as far as possible non-controversial social sources. Como es bien sabido, el rule of law, que hoy atrae una atención renovada, puede observarse desde múltiples puntos de vista, lo cual produce ambigüedad y malentendidos. Parece prometer más de lo que puede cumplir. No me ilusiono con que mis escritos sobre el tema sean útiles para su mejor comprensión y realmente espero que no hayan contribuido en su pequeñez a agitar aún más las aguas.
