January 7 2014 n. 61) Moving from the decision of the Sezioni Unite n. 61/2014 the author takes the opportunity to re-examine old and new problems related to the intervention of creditors in the forceable execution. The first major theme concerns par condicio creditorum which is examined in its evolutionary history since the Code Napoleon through its period of maximum extension (the Code of 1940) until its reduction as a result of the reforms of 2005. The author examines the possibility to overcome quoad effectum the distinction between sine titulo et cum titulo interveners in light of jurisprudence’s evolution between 1978 2009 and 2014. The possibility in particular concerns those creditors sine titulo the where credit has not been contested (ex art. 499 c.p.c.) by the debtor seek payment and partecipate to distribution. In the last section the author examines the possibilities for other creditors to contest the intervention of the creditor sine titulo ex art. 499 c.p.c. (utendo iuribus in subrogation in case of inaction of the debtor) or in the distribution phase ex art. 512 c.p.c. He concludes that the only person that will be really damaged if he doesn’t contest - ex art. 499 c.p.c. - the credit it is precisely the debtor. The “semantic universes” which however connote sport and “free time sports” have often appeared polarized. Commercial sport and sports professionalism are intertwined with the institutions of economics politics and culture which above all stress its “spectacularity” in order to capture first and foremost the audience. But also the sport of leisure time is intertwined with the actions of the institutions of economics politics and culture with the difference that these stress above all its “healthy value” aimed at the “healthy and rational” investment of time in an activity which improves the quality of life in the short medium and long period. This polarization between the consumption of sport entertainment - commercial sport - and the consumption of sport as a leisure activity - sport for all - has become increasingly interconnected precisely because of the increased collective identity demand via sport. In other words we have witnessed the spread of shape of sports entertainment that recall the importance of sports for psychophysical well-being for integration and social participation for the reduction of social inequalities ethnic and cultural differences and in which the importance assumed was weakened in the show from agonism from competition from the physical confrontation between two contenders or two teams. The text explains the difference between Marx?s concept of «oppression» and others as «coercion» by Durkheim or «domination» by Weber. The article then establishes, in a methodical way, the centrality of a passage from Capital, in which three different theories on «oppression» appear. This latter is in addition to the increase in shear strength resulting from the reduction of inter-stitial pressures that remains the principal scope of the draining trenches. Obviously the increase of shear strength due to the shear keys effect occurs if the trenches are filled with material that have enough strength and stiffness such as the porous concrete. In this case the beneficial effects of the draining trenches on stability are also due to the resistance at the concrete interface of the trench - soils and to the intrinsic resistance of the concrete at the area of the trench intersected by the sliding surface taken into consideration.The increase in resistance due to the shear keys effect can be very significant in relation to the thickness and interspace of the trenches.
