Este documento analiza desde una perspectiva tanto de Derecho comparado como de Derecho interno el fenómeno del "cumplimiento cooperativo" en el ámbito del Derecho Tributario, a la par que expone las principales peculiaridades e incidencias que se plantean en torno a la implantación de sistemas de gestión de riesgos fiscales para la correcta implementación de controles administrativo basados, no ya en la tributación punitiva, sino en relaciones de transparencia y confianza con el administrado. Ello con la finalidad de reducir el Tax Gap, aumentando los niveles de cumplimiento tributario a través de una asignación más eficiente de los recursos públicos.

The essay focuses on the discipline of the work done by one partner in the company of the other in cross-border couples and on the problems involved in this case. More specifically the focus is on the hermeneutical problems that arise both at the level of European legislation and at the level of Italian national discipline which is applicable according to European conflict criteria, showing the ambiguities and wide areas of shadow left uncovered by the latter.
