The comments on Arts. 34-40 of EU Regulation 2015/848 deal with opening of secondary insolvency proceedings. These comments systematically tackle the prerequisites required for the opening of secondary insolvency proceedings, the relationship between main and secondary proceedings and the duties of cooperation that are put on the courts and the insolvency practitioners of both main and secondary proceedings. A particular attention is devoted to the introduction of the so-called “Undertaking to Avoid the Opening of Secondary Insolvency Proceedings” (Art. 36).

The paper deals with cooperation in European cross-border cases. Two main ideas are put forward. The first idea is that cooperation requires a legal framework which is certain—otherwise, prescriptions imposing duties of cooperation and communication might produce ‘prisoner’s dilemmas’ and, paradoxically, an unwillingness to cooperate. The second idea is that prescriptions imposing duties of cooperation and communication have an intrinsic open texture—this characteristic ontologically requires courts and insolvency practitioners to make choices between different rulings and activities. Le decret du 2 mars 1848, qui reduit la duree du travail d’une heure, introduit une rupture majeure en instaurant pour la premiere fois une norme nationale fixant une duree maximale pour le travail des adultes. Cette decision souvent citee mais rarement etudiee suscita de multiples debats dans des arenes diverses, au Parlement, dans la presse comme dans les ateliers. L’objectif de cet article est de montrer comment cette decision prise dans le contexte d’effervescence revolutionnaire crea les conditions d’une irreversibilite de l’intervention de l’Etat dans le champ social.

This article edits, translates, comments and examines several aspects related with two strophic poems in Andalusian Arabic dialect. They are written in a miscellaneous volume recently found in Cútar (Málaga). Their contents speak about the hard moments lived during the last times of Muslim political power in the Iberian Peninsula. Mention is made to the copyist and the possible author of the poems.

Junto al epígrafe que la data, hay dibujados dos animales cuadrúpedos que quizá representen una escena de caza y una cenefa decorativa; conserva asimismo otros signos gráficos y diseños muy degradados que no ha sido posible descifrar totalmente. The Morisco Jesuit P. Ignacio de Las Casas collaborated in the translation of some of the lead books found in Granada at the end of the 16th century. At first he was a partisan of their authenticity, but he rapidly became convinced that they were false. There followed a fierce struggle to make the Church prevent their publication. In the article his activity as a translator of these texts is reviewed, together with the arguments, which he used in order to criticise the doctrine contained in the lead books.
