Jurisdiction in cross-border trademark infringements on the internet in the EU
2019
The Internet has transformed everything. And the area of intellectual property and private international law are not exceptions. This paper examines how jurisdiction rules, initially designed for offline cases, are applied in the context of online trademark infringement. It has been found that differentiation should be made with respect to national trademarks and the EU ones - Brussels I Recast applies to the former and European Trademark Regulation to the latter. With national trademarks, the jurisdiction may be granted on the basis of defendant's domicile, place of registration, place of activation of infringing content and the place of access to it. The same applies to the EU trademarks,…
Consumer protection in cases of unfair commercial practices, misleading advertisements, and defective products
2022
Consumer protection has always been an important element in the laws of every country and for good reason, because consumers bring profit, and this improves the economic situation of the country. But the excessive desire to dominate the market led to bad business practices, along with misleading advertisements and defective products. To keep consumers safe and protected, new laws have been formed to protect consumers and their economic well-being. The creation of the directive of uniform legislation for the European Union influenced the fact that national legislation had to be close to uniform requirements, however, weaker consumer protection than in the directive is prohibited. In connecti…
Gir garasjeleilighet merverdi til eneboligen?
2015
Muscle Function Differences between Patients with Bulbar and Spinal Onset Amyotrophic Lateral Sclerosis. Does It Depend on Peripheral Glucose?
2021
Background: One of the pathogenic mechanisms of ALS disease is perturbed energy metabolism particularly glucose metabolism. Given the substantial difference in the severity and the prognosis of the disease, depending on whether it has a bulbar or spinal onset, the aim of the study was to determine metabolic differences between both types of ALS, as well as the possible relationship with muscle function. Materials and Methods: A descriptive, analytical, quantitative, and transversal study was carried out in hospitals and Primary Care centers in the region of Valencia, Spain. Fasting glucose and alkaline phosphatase (AP) levels in venous blood, muscle percentage, fat percentage, muscle streng…

Prognostic Impact of let-7e MicroRNA and Its Target Genes in Localized High-Risk Intestinal GIST: A Spanish Group for Research on Sarcoma (GEIS) Study
2020
MicroRNAs (miRNAs) are small non-coding RNAs that negatively regulate gene expression at the post-transcriptional level, and they have been described as being associated with tumor prognosis. Here, miRNA profiling was planned to explore new molecular prognostic biomarkers in localized intestinal high-risk GIST. Paraffin tumor blocks of 14 and 86 patients were used in the discovery and expansion sets, respectively. GeneChip miRNA v3.0 was employed to identify the miRNAs differentially expressed between relapsed and non-relapsed patient samples, which were validated in the expansion set, by qRT-PCR. RT2 Profiler PCR Array was used for the screening of let-7e targets. Expression levels were co…
The influence of current EU public procurement legislation on the construction industry within the EU
2019
The aim of the master thesis is to identify the role of EU public procurement legislation in ensuring the common market principles in the public procurement procedures within the construction industry. In this thesis, the influence of the EU legislation on the public procurement market of the construction industry will be studied. The most important factors which hinder the involvement of foreign companies in procurement procedures of other member states will be determined and analysed.
Testing chemical carcinogenicity by using a transcriptomics HepaRG-based model?
2014
The EU FP6 project carcinoGENOMICS explored the combination of toxicogenomics and in vitro cell culture models for identifying organotypical genotoxic- and non-genotoxic carcinogen- specific gene signatures. Here the performance of its gene classifier, derived from exposure of metabolically competent human HepaRG cells to prototypical non-carcinogens (10 compounds) and hepatocarcinogens (20 compounds), is reported. Analysis of the data at the gene and the pathway level by using independent biostatistical approaches showed a distinct separation of genotoxic from non-genotoxic hepatocarcinogens and non-carcinogens (up to 88 % correct prediction). The most characteristic pathway responding to …
Pain neuroscience education and physical exercise for patients with chronic spinal pain in primary healthcare: a randomised trial protocol.
2019
AbstractBackgroundChronic musculoskeletal pain affects more than 20% of the population, and the prevalence is increasing, causing suffering, loss of quality of life, disability, and an enormous expenditure on healthcare resources. The most common location for chronic pain is the spine. Many of the treatments used are mainly passive (pharmacological and invasive) and poor outcomes. The treatments currently applied in the public health system do not comply with the recommendations of the main clinical practice guidelines, which suggest the use of educational measures and physical exercise as the first-line treatment. A protocol based on active coping strategies is described, which will be eva…
7 YEARS OF EUROPEAN FUNDING IN ROMANIA - BETWEEN SUCCESS AND FAILURE
2015
This paper aims to achieve an overall picture of the absorption rate of European funds in Romania for the 2007-2013 programming period and to propose a series of recommendations on the steps our country needs to follow in order to improve the process of accessing and implementation of structural instruments at national level. These recommendations focus on preventing obtaining a low rate of absorption of EU funds allocated to Romania in the multiannual financial framework 2014-2020 , thus preventing wastage prospects of economic and social modernization , that these funds offer.
