The article aims to provide a short overview of the current situation regarding public access to information, participation and access to justice in Europe. The article briefly presents the role of the Aarhus Convention and its compliance mechanism in shaping the respective legal framework at both national level and EU level. On that basis it summarises some key challenges and implementation problems respectively in relation to public access to information, participation and access to justice.

Abstract The article present the key elements of the access to justice pillar of the Arhus Convention against the background of its legislative history, conceptual approaches and motivations laying behind certain provisions. The rapid introduction of the normative frame on the European scale, both communally and nationally, follows the historical investigation presented in the first chapter of this dissertation, with a double purpose: to define the issues of the current debate on the one hand and to describe the state of the art on the other. The practical implementation of the goals of smart sustainable cities has different forms. This paper explores an example of the Danish smart city Aarhus, through which the so-called ‘Scandinavian third way’ of smart city development is being proposed. The foundations of the ‘third way’ are directly derived from the Scandinavian tradition of cooperation; it is supposed to be an alternative to the more commercial American model and the more centrally-controlled Asian tradition.
