L’a. affronta il discusso problema dei rapporti tra appello incidentale e mera riproposizione ex art. 346 c.p.c., soffermandosi sulle diverse soluzioni offerte in argomento dalla più recente giurisprudenza di legittimità. In particolare, l’analisi si concentra su Cass., Sez. Un., n. 1179/2017, che tratta prevalentemente del meccanismo di devoluzione in appello sia delle eccezioni respinte sia di quelle assorbite in prime cure, prospettando soluzioni – ad avviso dell’a. – non sempre condivisibili e coerenti.

Il contributo esplora le modellistiche del concordato sui motivi di appello reintrodotto dalla novella del 2017 dopo le sinusoidali vicende che ne avevano caratterizzato l’esistenza pregressa, dal primo varo nell’impianto originario del codice del 1988 alla declaratoria di incostituzionalità del 1990, alla reclamata reintroduzione, operata nel 1999, al non meno sorprendente rito sacrificale consumatosi nel 2008: il meccanismo appare, oggi, sintonico rispetto al programma generale di razionalizzazione empirica del quadro delle impugnazioni penali nel merito, pur se non pochi permangono gli aspetti chiaroscurali che tradiscono opacità e distonie di sistema.

Although this Palestinian town has been known since prehistoric times and it is mentioned in the Bible, there is no archaeological proof which would confirm its location. In 2011, the name Sodoma was removed from the official list which includes Polish equivalents of geographical names of the world. However, the onym is still used in the Polish language. Cholesterol reacts under Appel conditions (CBr4/PPh3) to give 3,5-cholestadiene (elimination) and 3β-bromocholest-5-ene (substitution with retention of configuration). Thus, the bromination of cholesterol deviates from the stereochemistry of the standard Appel mechanism due to participation of the Δ5 π-electrons. In contrast, the subsequent azidolysis (NaN3/DMF) of 3β-bromocholest-5-ene proceeds predominantly by Walden inversion (SN2) affording 3α-azidocholest-5-ene. The structures of all relevant products were revealed by X-ray single crystal structure analyses, and the NMR data are in agreement to the reported ones.
