Il diritto europeo dello sport, tra specificità, rilevanza economica e motivi imperativi di interesse generale
2018
European Sports Law, between Specificity, Economic Relevance and Overriding Reasons of General Interest The most recent European case law has, once again, raised the question on whether sports law can be regarded as an original and separate branch of legal systems. At European level, sports law is deeply integrated in the legal system and, therefore, it is subject to its regula- tions. This phenomenon is however mitigated by the social function of sport, which, together with technical regulations, provides an important area of legislative, organizational and judicial autonomy to sports law. The ordering principle between sports law and the European legal system is thus identified in the pri…
Contra Raz, su autorità teoriche e pratiche
2018
In this article, I will argument that, against the thought of Raz, theoretical authorities and practical authorities have not the same fundamental structure. In particular, theoretical authorities can be structured according to Raz’s theory or Perry’s theory, while practical authorities are very different.
Financial Incentives for Living Organ Transfer?
2020
In 2012, almost 4,500 people died in the United States while waiting for kidney transplants. In 2013, 4,100 died in the European Union while officially placed on waiting lists. To solve this problem, there are essentially two ethi-cally acceptable solutions; but both have, in their current state, disadvantages. The first solution would be having financial incentives for living organ transfer. The second one would be adopting a model, like the Spanish or Cro-atian ones, which we can denominate as the «imperfect altruistic» model. En 2012, casi 4500 personas murieron en Estados Unidos mientras esperaban trasplantes de riñón. En el transcurso de 2013, 4100 pacientes murieron en la Unión Europe…
Rules, Conventionalism and Normativity: Some Remarks Starting from Hart
2014
The paper deals with the “conventionalist turn” in legal positivism in relation to the matter of the duty to obey the law and legal normativity. In this respect, conventionalist legal positivism is worth considering (a) because it offers an explanation of legal normativity partly different vis-a-vis previous ones and (b) because it tries to preserve the autonomy of legal obligation from moral obligation and coercion, respectively. Here I will only focus on legal conventionalism as sketched out by Hart in the Postscript. Indeed, Hart’s conventionalism comes up against problems which to some extent also affect other distinguished versions of legal conventionalism like, for example, those work…
Esercizi di confutazione su eutanasia e suicidio assistito
2013
In this article, I will offer a definition of active euthanasia, of passive euthanasia and of physician-assisted suicide. Secondly, because I believe in the value of individual autonomy, I will confutate some arguments adduced against the legalization of voluntary euthanasia and physician-assisted suicide. In particular, five arguments. The slippery slope argument, the perfectionist moral argument, the theological argument, the patients’ vulnerability argument, the life’s sacred value argument.

La tutela della vulnerabilità in ambito giuridico. Rilevanza del concetto nel contesto della tratta e del traffico di persone migranti
2022
The legal system started to use the word “vulnerability” to provide protection in cases of abuse or need. Understanding the double face of vulnerability, as both universal and individual, may lead us to overcome the traditional liberal paradigm and its idea of indi-viduals independent and autonomous, and finally embrace an idea of legal subject based on his inherent vulnerability. The differences between these paradigms are evident in the fields of migration and human trafficking. This paper proposes to rethink the approach to migration starting from vulnerability.

The effects of using participatory working time scheduling software on working hour characteristics and wellbeing : a quasi-experimental study of irr…
2020
Background: Studies in the health care sector indicate that good work time control is associated with better perceived wellbeing but also with non-ergonomic work schedules, such as compressed work schedules. Participatory working time scheduling is a collaborative approach to scheduling shift work. Currently, there is a lack of information on whether working hour characteristics and employees' wellbeing in irregular shift work change after implementing participatory working time scheduling. Objective: To investigate the effects of using digital participatory working time scheduling software on working hour characteristics and well-being among Finnish hospital employees. Participants and met…
Predicting school students’ physical activity intentions in leisure-time and school recess contexts: Testing an integrated model based on self-determ…
2021
BackgroundIdentifying psychological correlates of children's physical activity intentions may signpost potentially modifiable targets for interventions aimed at promoting physical activity participation. School recess and leisure-time outside of school are appropriate contexts in which such interventions may be delivered. However, few studies have identified correlates of physical activity intentions in these environments. Examining correlates in these contexts may provide formative evidence on which to base interventions to promote physical activity.PurposeThe current study adopted an integrated theoretical model to test relations between motivational constructs from self-determination the…
