NET ZERO ENERGY BUILDINGS: AN ITALIAN CASE STUDY. ANALYSIS OF THE ENERGY BALANCE AND RETROFIT HYPOTHESIS IN ORDER TO REACH THE NET ZERO ENERGY TARGET.

2014

In the last years the concept of Net Zero Energy Building (NZEB) has been developing and spreading in the scientific community. The work presented in this thesis has been largely developed in the context of the International Energy Agency (IEA) joint Programme Solar Heating and Cooling (SHC) Task40 and Energy Conservation in Buildings and Community Systems (ECBCS) Annex52: Towards Net Zero Energy Solar Buildings. It is known that the energy consumption in Europe for residential and commercial buildings is around 40 % of the total production. It is then extremely important to optimize both the implementation of energy efficiency measures and the usage of renewable resources that can be harve…

F.A.L.C.A.D.E.: A fuzzy software for the energetic and environmental balances of products

2004

It is generally well known that the reliability of Life Cycle Analysis (LCA) studies depends upon exact, complete and sharp input data that, unfortunately, are not always available. Furthermore, when available, the input data are affected by uncertainty whose importance is not always adequately taken into consideration. This paper describes the software F.A.L.C.A.D.E. (Fuzzy Approach to Life Cycle Analysis and Decision Environment): a tool designed for the calculation of the eco-profile of products, based on a fuzzy logic approach. The originality of the method already treated in other papers is to use the fuzzy representation to manage the complex relationships that arise in compiling an e…

Striking a Balance among Security, Privacy and Competition. The Data Retention and Investigatory Powers Act 2014 (DRIP)

2015

Following the ECJ decision that declared the Data Retention Directive invalid, the Data Retention and Investigatory Powers Act 2014 (DRIP) has been enacted. It is not indisputable whether the DRIP gives more powers to the intelligence services at the detriment of both citizens’ privacy and freedom of enterprise or whether it simply clarifies the nature and extent of obligations that can be imposed on telecommunications service providers based outside the UK under Part 1 of the Regulation of Investigatory Powers Act 2000 (RIPA). The article provides news also on Data Retention Regulations 2014, R (David Davis MP and Tom Watson MP) v Secretary of State for the Home Department and the proposed…

THE NEW ARCHITECTURE OF THE EUROPEAN ECONOMIC GOVERNANCE AND ITS CONSTITUTIONAL IMPLICATIONS AT THE EU AND NATIONAL LEVEL

2019

Article 3.1 of the Italian Constitution enshrines the principle of equality and the prohibition of discrimination, based on “gender, race, language, religion, political opinion, personal and social conditions”. Additionally, Article 48 grants an equal right to men and women to vote, and Articles 56.3 and Article 58.1 establish the right to be elected to the Camera dei Deputati and the Senato della Repubblica without any reference to the gender of the candidates. Men and women voted in Italy the first time in an institutional referendum on 2 June 1946 to choose between a Republic and a Monarchy. However , the right for women to be elected came many years later, after a long and hard-fought s…

Alcune osservazioni sull’effettività del principio delle pari opportunità

2021

Observations on the principle of equal opportunities effectiveness The aim of this brief paper is to analyse the path to achieving gender balance (provided by Art. 51 of the Italian Constitution) in the Italian constitutional system. Departing from the Italian Constitutional Court judgement no. 4/2010, various Italian administrative court decisions will be examined. In addition, the recent Italian State Council judgement no. 4294/2021 will also be analysed: it declared that the gender balance principle is immediately mandatory and it does not need to be given legal effect by Parliament.

Il difficile cammino verso la parità di genere nell’accesso alle cariche elettive

2021

The aim of this paper is to analyse the evolution of gender balance in the Italian Constitutional system with respect to electoral representation. Even if Art. 51th of the Italian Constitution provides that “Any citizen of either sex is eligible for public offices and elected positions on equal terms, according to the conditions established by law. To this end, the Republic shall adopt specific measures to promote equal opportunities between women and men”, effective achieving of electoral representation has been heavily difficult for women in Italy. The Italian Constitutional Court in 1995 (judg. no. 422) declared the use of electoral quotas in lists of candidates unconstitutional, even if…

The Introduction of the “Balanced Budget” Principle into the Italian Constitution: What Perspectives for the Financial Autonomy of Regional and Local…

2013

This paper analyses the impact on regional and local authorities of Articles 117 and 119 of the Italian Constitution as amended by Constitutional Law no. 1/2012. In particular, it attempts to verify whether the new formulation of these constitutional provisions materializes the risk of a significant reduction in the financial autonomy of both Regions and Local Governments. With the constitutional reform the legislative competence of “harmonization of public account” has become an exclusive State competence, the “balanced budget” principle has been extended to Regions and local authorities and public borrowing has been broadly prohibited. What is the actual significance of the changes introd…

Il ruolo del Consiglio europeo nella Brexit

2019

The European Council has been playing a leading role in Brexit procedure. This article aims at showing how this role does not simply reflect the powers explicitly assigned to the European Council under Article 50 TEU. Two more questions are addressed: In performing its role h…
