Celem artykułu jest omówienie wybranych instytucji postępowania zabezpieczającego w kontekście specyfiki spraw gospodarczych. Wnioski o udzielenie zabezpieczenia w tego typu sprawach wpływają do sądów dość często, zwłaszcza w sprawach o stwierdzenie nieważności uchwały bądź jej uchylenie. Achieving both creativity and rationale : reuse in design with images and claims

Although designers often try to create novel designs, many designs are based on previous work. In this paper we argue for the reuse of rationale, in the form of claims, as a central activity in design, and explore how this can be used to inspire creativity. We present a design activity in which images and claims are reused to create a storyboard and illustrate how creativity and rationale complement each other. Our work serves to demonstrate that an appropriate design activity can be used to leverage creativity with the use of rationale. peerReviewed
Claims secured by a registered pledge in sanation proceedings

This study concerns the legal situation of a receivable secured by a registered pledge in a debtor’s sanation (restructuring) proceedings. The registered pledgee has a special position in the course of such proceedings. The study discusses the rules of subjecting the receivable secured by the arrangement, the rules of preparing and contesting the list of receivables, and finally the rules of satisfying the pledgee.

Niniejsze opracowanie odnosi się do problematyki wpływu otwarcia przyspieszonego postępowania układowego z układem częściowym na postępowanie egzekucyjne dotyczące wierzytelności zabezpieczonej rzeczowo na składnikach majątku dłużnika. Zaprezentowany zostanie pogląd prawny, i jego uzasadnienie, według którego, w przypadku gdy wierzytelność zabezpieczona rzeczowo na majątku dłużnika zostaje objęta układem częściowym wówczas egzekucja co do niej ulega bezwzględnemu zawieszeniu z mocy samego prawa (ipso iure)
