A Self-Funding Reward Mechanism for Tax Compliance

We compare in a laboratory experiment two audit-based tax compliance mechanisms that collect fines from those found non-compliant. The mechanisms differ in the way fines are redistributed to individuals who were either not audited or audited and found to be compliant. The first, as is the case in most extant tax systems, does not discriminate between the un-audited and those found compliant. The second targets the redistribution in favor of those found compliant. We find that targeting increases compliance when paying taxes generates a social return. Diversi sono i fallimenti aziendali ai quali si è assistito negli ultimi decenni. In molti casi (Enron, Xerox, Parmalat)1 la causa principale del fallimento è riconducibile a debolezze e mancanze nel Sistema di Controllo Interno (SCI). Il SCI è costituito dall’insieme delle regole, delle procedure e delle strutture organizzative consentire che consentono l’identificazione, misurazione, gestione e monitoraggio dei principali rischi, così come previsto dal Codice Autodisciplina del 20152. Nelle situazioni di crisi il SCI non ha funzionato adeguatamente, determinando una non corretta, non coerente gestione dell’impresa rispetto agli obiettivi prefissati.

This contribution addresses some problems regarding the two core aspects of Schauer’s proposal discussed by his critics in this book: the method of defining law (his proposal of anti-essentialism) and the definition of law based on the ubiquity of coercion. In this introduction, both aspects will be discussed pushing to the very limit the idea of law as a differentiated phenomenon. This means that legal theory has to take non-state law seriously.
