The Theory of Forms Without Substance a Romanian Legal Transplant Theory Ahead of its Time
2020
Abstract Comparative law and legal history show us that law is dynamic, always in continuous development, change, or mutation. This dynamic dimension has become a central concern for the comparative law scholars. The circulation of legal models in the world (e.g. legal transplant, legal transfer, legal borrowing, legal migration) is an evergreen issue. This phenomenon has provoked numerous doctrinal disputes, which have been encapsulated in complex theories on its possibilities and impossibilities. In the present article, we will not explore the many modern theories regarding legal transplantation (or under other metaphors). Instead, we will go back in time, in the second half of the ninete…
The Latvian referendum on Russian as a second state language, February 2012
2016
On 18 February 2012 Latvian citizens participated in a referendum on making Russian a second official (“state”) language. The proposal was rejected by three-quarters of voters. There is a complex background to language policy in Latvia, where since regaining independence in 1991 the country has promoted Latvian as the only state language, though Russian and other languages are widely used at a societal level. The language law and associated citizenship law in Latvia (as in Estonia) have received considerable commentary, with recent significant writings disagreeing strongly regarding their interpretation. These laws have also very often been criticized by both European institutions and by Ru…

Spain is a country with twelve autochthonous languages. The modern Spanish nation-st…
2021
In Bolivia, the third term and the habilitation of former President Evo Morales to the 2019 presidential elections was allowed with the acquiescence of the Plurinational Constitutional Court. Despite the fact that the Constitution prohibited it and there was a referendum that rejected indefinite presidential re-election. This occurred through the judicialization of politics that produced a non-formal reform of the Constitution producing a case of abusive constitutionalism and the destabilization of the rule of law.
Inheritance rights of life partnerships in recent doctrine of the Constitutional Court
2015
La STC 93/2013 y el ATC 280/2013 se han referido a esta cuestión, abriendo una forma de aproximación a la misma Until recently, the inheritance rights of life partnerships had not been subject to decisions of the Constitutional Court 93/2013 STC and 280/2013 ATC have made statements about giving a new approach to this issue
El constitucionalismo democrático y social : orígenes y características distintivas
2020
The paper aims to reconstruct the doctrinal evolution of the juridical thought in the transition from liberal constitutionalism - identifiable with the nineteenth-century theories of the "rule of law" - to democratic-social constitutionalism that inspires and shapes the "Welfare State". In short, democratic-social constitutionalism can be viewed as the fundamental core of the social pact through which the European and Western civilisation manages to provide a democratic alternative to the disintegration of the liberal states. The main features of the new constitutionalism will be analyzed by focusing on what, in our opinion, can be considered its main “pillars”.
Equality by reason of filiation and succession law
2019
The constitutional principle of equality of filiation only applies to successions opened after the entry into force of the constitution. The paper reviews the most recent case law on the subject.
