Bodźce pozacenowe w kontraktach rolnych. Powiązania umowne między grupami producentów rolnych a ich pierwszymi odbiorcami w Polsce

Celem artykułu jest identyfikacja stosowanych bodźców pozacenowych w umowach rolnych, które mogłyby potencjalnie skłaniać agenta do działania zgodnego z interesem kontraktora. Zastosowanie tego typu zachęt może potencjalnie minimalizować problem pokusy nadużycia ze strony agenta jeszcze w trakcie jej obowiązywania, tj. w trakcie produkcji rolnej. Dla realizacji założonego celu wykorzystano badanie własne z użyciem ankiety. Simple flume with a central baffle

Abstract In this paper the stage-discharge relationship of a flume with a central baffle is theoretically deduced using the Buckingham-Theorem of the dimensional analysis and the self-similarity theory. The new stage-discharge equation is calibrated by the measurements carried out by Peruginelli and Bonacci using a baffle having a given throat length and five different values of the contraction ratio. Finally, for a given throat length, a relationship linking the discharge with the upstream water depth, the contraction ratio and the contracted width is deduced.

La aproximación conductual a la transparencia contractual en los servicios financieros de crédito

El deber de información se ha consagrado como la herramienta estrella del derecho contractual de consumo. Su proliferación a lo largo del ordenamiento jurídico es una realidad por pocos negada. Sin embargo, su utilización ha demostrado pocas evidencias de éxito. Lo que nos lleva a cuestionar la naturaleza de las premisas teóricas sobre las que se fundamenta. En especial, aquellas relacionadas con la imagen del consumidor medio adoptada tanto a nivel normativo como jurisprudencial. Con el presente artículo, pretendemos cuestionar la eficacia de los deberes de información como herramientas encaminadas a evitar la celebración de contratos con clausulado asimétrico.

Ageing is associated with a decline in muscle mass and strength leading to increased physical dependency in old age. Postmenopausal women experience a greater decline than men of similar age in parallel with the decrease in female sex steroid hormone production. We recruited six monozygous female twin pairs (55–59 years old) where only one twin pair was on hormone replacement therapy (HRT use = 7.8 ± 4.3 years) to investigate the association of HRT with the cytoplasmic volume supported by individual myonuclei (myonuclear domain (MND) size,) together with specific force at the single fibre level. La gestione dell’inadempimento contrattuale negli smart contract

Il contributo ha l’obiettivo di prospettare soluzioni giuridiche alla gestione delle sopravvenienze contrattuali negli smart contract, ipotesi che sembra in contrasto con la loro rigida struttura, che dà luogo all’automatica esecuzione degli stessi. Strumentale è anche il confronto con il sistema giuridico tedesco, grazie al quale si avvalora la tesi che gli smart contract non sono una nuova tipologia contrattuale, ma una formazione digitale dello stesso, al quale però vanno applicati sia i principi generali del contratto sia soluzioni giuridiche già esistenti, benchè adattati all’ultima evoluzione tecnologica, sempre più incline alla dematerializzazione del contratto.

The author proposes a new interpretation of the well-known Ulpian’s and Pedius’ words contained in D. 2.14.1.3, which is based on the idea that ‘conventio’, despite its common assumption as equivalent of ‘consensus’ (in the abstract sense of subjective element of a contract), rather alludes to the content of the ‘consensus’ as the objective result of a coinciding perception and will (‘in idem sentire’) between the contracting parties.

Education systems in Francophone African countries are undergoing major reforms, consequence of the international commitment to achieve Universal Primary Education (UPE) by 2015.
