This paper deals with the presumption of innocence and the law enforcer's incentives to exert investigative effort. Our main result is that, even if the presumption of guilt maximizes deterrence for a given effort by the law enforcer, divergent objectives between the law enforcer (who maximizes the probability of a conviction weighted by the magnitude of the sanction and the type of the citizen) and the public decision-maker (who minimizes social costs) may lead the latter to prefer the presumption of innocence. With the theory of “Belief in a Just World” (BJW), Lerner (1970, 1980) has given an explanation as to why people blame innocent victims for self-infliction of their fate and why they derogate innocent victims. They do so to deny injustices, respectively, to defend their belief in a just world. BJW in its most general form implies the conviction that everybody gets what he or she justly deserves. The other side of the coin is that everybody deserves what happens to him or her. When oneself or others enjoy advantages or suffer disadvantages, we care about justice. BJW motivates the search for legitimate reasons. Deservingness is the most legitimate reason for many people.

EC policy reveals a strong conviction that CSO’s main function in EU-funded research and innovation projects is to take care of the ‘societal perspective’, which would not be adequately represented otherwise.
