This chapter focuses on recent legislation that has concerned certain levels of the Public Administration, with particular reference to those interventions that are based on a constant process of empowering people within the usual place of work. In this sense, the focus is particularly on the tool called whistleblowing. Specifically, it is a practice aimed at indicating the presence of the violation of one or more rules within the usual place of work. In the chapter I dwell on some problematic aspects related to the relevant legislation also through some comparisons with the US legislation.

This essay presents current criticisms against a “mentalistic” interpretation of the practice of understanding others as providing some reasons for a redefinition of the structure of the problem rather than for its deconstruction. More specifically, I hypothesize that the problem of reconciling the practical status of our understanding with the reflective stance needed to understand and assess apparently “out of context” behavior is a legitimate one, and that the analysis of the normative structure of cooperative interaction provided by John Searle and Paul Grice can provide us with the tools to deal with this problem.

From ‘Prisoner's Dilemma’ to Reluctance to Use Judicial Discretion: The Enemies of Cooperation in European Cross-Border Cases

The paper deals with cooperation in European cross-border cases. Two main ideas are put forward. The first idea is that cooperation requires a legal framework which is certain—otherwise, prescriptions imposing duties of cooperation and communication might produce ‘prisoner’s dilemmas’ and, paradoxically, an unwillingness to cooperate. The second idea is that prescriptions imposing duties of cooperation and communication have an intrinsic open texture—this characteristic ontologically requires courts and insolvency practitioners to make choices between different rulings and activities. Coopetitive Dynamics in Distribution Channel Relationships: An Analysis of the Italian Context in the Twentieth Century

Through the analysis of the evolution of channel relationships in Italy during the twentieth century, this paper illustrates retrospectively the main factors and determinants underlying the emergence of coopetitive relationships in vertical distribution interactions and, furthermore, allows to identify different forms of coopetitive relationships in distribution channels.
