Wartość bezpieczeństwa prawnego jako podstawa demokratycznego państwa prawa w świetle art. 2 konstytucji RP

Niniejszy artykuł podejmuje problematykę znaczenia wartości bezpieczeństwa prawnego – jej formalnych i materialnych aspektów - w świetle instytucjonalnych przemian ładu normatywnego i w kontekście aksjologii współczesnego konstytucjonalizmu. Wartość bezpieczeństwa prawnego stanowi jeden z fundamentów demokratycznego państwa. Refleksja konstytucyjna nie odwołująca się do wartości bezpieczeństwa prawnego, jak również nie wskazująca możliwych konsekwencji pomijania tej wartości jako konstruującej ład normatywny może prowadzić do destrukcji tego dyskursu.
'Manu(m) conserere' e 'omnibus verbis vindicare' (Gell. 20.10.7)

Rivalorizzando la lezione originaria di Gell. 20.10.7 tramandata nel manoscritto fiorentino delle Notti Attiche, secondo cui il manum conserere delle XII Tavole comportava un "omnibus verbis vindicare", si contrappone la vindicatio bilaterale e contenziosa della legis actio sacramenti in rem alle vindicationes unilaterali di altre legis actiones non contenziose. Inoltre, alla luce di una rilettura delle testimonianze di Gaio e Cicerone si distingue fra il manum conserere e l'ex iure manum consertum vocare della procedura avente per oggetto la rivendica di beni immobili.

Con la fine della dittatura fascista e del secondo conflitto mondiale ha inizio per l’Italia un processo di ricostruzione materiale e si avverte la necessità di rifondare su basi democratiche il sistema politico istituzionale. La riconquistata libertà permette la ripresa di un dibattito politico che avrebbe consentito l’affermazione della democrazia moderna. Il confronto serrato, a tratti anche acceso, tra alcuni degli esponenti più rappresentativi di quella indimenticata stagione politica e tra scuole di orientamento politico diverso, è oggetto di riflessione nei saggi del presente volume.

This article analyzes the genesis and meaning of the concept of a “social rule of law” (sozialer Rechtsstaat) which Heller put forward in the particular context of The Weimar Republic. Heller was at this time one of the jurists who criticized the liberal ideal of law. He instead promoted a social conception that would take socio-economic inequalities into consideration. However, this did not imply eliminating the rule of law; it was rather a question of extending it or elevating it to a higher point – which he called “social democracy” and from 1929, “social rule of law”. In the context of the crisis of democracy, this kind of statement clearly had a political dimension.

A pivotal tenet in modern behavioral sciences is that the study of behavior, in its most intimate structure, necessarily deals with time and, for this reason, behavioral dynamics are not intuitively perceivable and/or detectable (Eibl-Eibesfeldt, 1970).
