The Relocation of the Canons Regular Monastery in Żagań as an Element in the Reform of Interior Life

2019

Dotyczyło to zarówno braci, ojców, wyższych funkcyjnych klasztornych, a nawet samych opatów.

The Relocation of the Canons Regular Monastery in Żagań as an Element in the Reform of Interior Life

2019

The location in which a church was based played an important role in the life of religious communities in the Middle Ages. Interactions with society and the mutual influence of a monastery on the surrounding societies could support or inhibit the development of an abbey. There were situations when monks were moved to serve in different locations. In Silesia, we have two examples of canons regular monasteries. Both the monastery of the Blessed Virgin Mary in Wrocław and the convent of Żagań were originally located in other places. As described in the monastery chronicle, the transfer of the monastery from Nowogród Bobrzański to Żagań in 1284 was an event that opened new opportunities and per…

Evolution of the suicides’ right to funeral and burial in Canon Law and Polish Law

2020

For centuries, funeral law was not too favourable to suicides. Admittedly, at the dawn of Christianity this group of the deceased was not refused religious funeral celebrations or a burial, yet, the situation changed along with the Catholic religion gaining significance. At the beginning of the Middle Ages, suicides were deprived of the right to a religious funeral. Furthermore, in the 11th century the ecclesiastical legislator forbade burial for suicides in “holy places.” Until modern times, therefore, suicides were buried at a distance from grave- yards. This in practice often indicated a burial insulting human dignity. The monopoly on religious funeral regulations only ended in Europe at…

Expiration of Time Limits and the Ius Appellationis

2022

The rotal decree under comment offers the cue to address the delicate topic of the appeal and the peremptory time limits for its presentation, especially in light of the recent reform of the canonical matrimonial process promulgated by Pope Francis. On the basis of the new structure of the process of matrimonial nullity appears, in fact, evident the legislative disfavor, towards the appeal, seen as a potentially dangerous tool for the salus animarum of the faithful for the risk of procedural lengths connected to it, so as to provide for a prior examination of admissibility in order to avoid that they were made for the purpose of mere dilatory, that is, for the sole purpose of lengthening the…
