Trademarks and Cyberspace
2006
Trademark law aids consumers who use trademarks in the marketplace to identify swiftly and without problems a product they liked or disliked in the past, distinguishing among the different competing manufacturers of a product. No one is entitled to sell or deliver commodities under the appearance that the commodities derive from someone else. The importance of consumer protection cannot be over-emphasized and the average consumer standard should remain the central point of the inquiry, even under domain name litigation. Replacing the initial interest confusion doctrine is one decisive step, along with the introduction of a doctrine representing the fact that there should be no confusion at …
Adaptive Tracking Control of Nonlinear Time-Varying Systems with Unknown Control Coefficients and Unknown Time-Varying Parameters
2019
This paper investigates the tracking control of a class of strict-feedback uncertain nonlinear systems in the presence of unknown signs of control coefficients and unknown time-varying parameters as well as unknown disturbances. A robust adaptive controller and a new decoupled backstepping approach to stability analysis are developed by constructing a new compensation scheme. By introducing a Nussbaum function and a new type of hyperbolic tangent function, the effects of unknown time-varying parameters and unknown control coefficients are effectively compensated. By using the decoupled backstepping technique, it is proved that under the proposed control, all closed-loop states are uniform u…
Network Slicing Enabled Resource Management for Service-Oriented Ultra-Reliable and Low-Latency Vehicular Networks
2020
Network slicing has been considered as a promising candidate to provide customized services for vehicular applications that have extremely high requirements of latency and reliability. However, the high mobility of vehicles poses significant challenges to resource management in such a stochastic vehicular environment with time-varying service demands. In this paper, we develop an online network slicing scheduling strategy for joint resource block (RB) allocation and power control in vehicular networks. The long-term time-averaged total system capacity is maximized while guaranteeing strict ultra-reliable and low-latency requirements of vehicle communication links, subject to stability const…
Geographical Database Watermarking by Polygon Elongation (Technical Report)
2007
Due to the ease of digital copy, watermarking is crucial to protect the intellectual property of rights owners. We propose an effective watermarking method for vectorial geographical databases, with the focus on the buildings layer. Embedded watermarks survive common geographical filters, including the essential squaring and simplification transformations, as well as deliberate removal attempts, e.g. by noise addition, cropping or over-watermarking. The impact on the quality of the datasets, defined as a composition of point accuracy and angular quality, is assessed through an extensive series of experiments. Our method is based on a quantization of the distance between the centroid of the …
Le formalisme conventionnel : illustration de la notion de contrat-cadre
1986
The usual contract is an agreement which creates obligations. The framework contract is an agreement which produces norms. This paper will outline the general theory of the framework contract, illustrated by one of it's multiple practical applications : the conventional formalism which incorporates those agreements determining the nature of expression or communication of intention in future juristic acts.

Les problèmes de preuve posés par l'évolution des sciences et des technologies
2001
International audience; That law is seeking for truth is certainly not new. However, proof and scientific expertise have received increasingly attention in the context of legal evidence. What are the relationship between scientific truth and legal evidence ? The aim of this paper is neither to assess the potential conflict between scientific truth and legal evidence, nor to measure in what extend scientific method might be applied to legal decision-making process. The paper is rather an attempt to point out some problems caused by scientific discoveries and technological advances in the context of legal evidence. Scientific progress is a chain of certainties and uncertainties. From their pr…

Leveraging the benefits of big data with fast data for effective and efficient cybersecurity analytics systems : A robust optimisation approach
2020
In recent times, major cybersecurity breaches and cyber fraud within the public and private sectors are making international headlines. Majority of organisations are facing cybersecurity adversity and advanced threats. On the one hand, we have asynchronous cybersecurity practices, many standards and frameworks to consider while on the other hand, we have to deal and secure our organisations against cyber-criminals, organised hacktivists, insider threats, hackers and nation-states with malafide intentions. The Center for Cyber Safety and Education's Global Information Security Workforce Study (GISWS) confirms that globally we are not only loosing but also backpedalling against threats and ri…
