Legal systems’ constitutionalization increases legal flexibility at the expense of legal certainty; it imposes to legislators, judges and individuals the responsibility and the as…
Principles, balancing, and the separation between law and morals: on neo-constitutionalism and its critics
2011
2014
The essay discusses three key-concepts in Luigi Ferrajoli’s legal philosophy; these concepts are: constitution, legal positivism, and democracy. Ferrajoli articulates these concepts in an interestingly original way and, in his latest book La democrazia attraverso i diritti, also stresses their interconnection. The essay critically assesses Ferrajoli’s use of these concepts, and in the process also highlights some problems with Ferrajoli’s “formal” definition of fundamental rights.

L'Economista Anglofilo. Paolo Balsamo e l'utopia liberale in Sicilia (1787-1816)
2023
Paolo Balsamo -economist and professor of University of Palermo from 1787 to 1812- was a traveller and expert in the most advanced and modern British and European agriculture. He wrote articles and essays, both in English and Italian, on agriculture and political economy and was a correspondent of important cultural and political circles of British Whiggism. As a member of the Sicilian Parliament, ideologist of the constitutional party and trusted collaborator of Lord Bentinck, he wrote the Sicilian Constitution of 1812 which reformed the old institution of the Kingdom of Sicily transforming it into a liberal State. This monography explores Balsamo's intellectual and political figure throug…
Rights, the Distribution of Wealth, and Happiness: Gaetano Filangieri’s Constitutional Ideal of Justice
2018
This article presents the ideal of distributive justice of Gaetano Filangieri whose realization is entrusted to the constitutional project elaborated in his work La Scienza della Legislazione. The article shows the main features which, in the outline of the Enlightenment, distinguish the core of the Filangerian proposal: the happiness of the nation needs an equitable distribution of wealth; the definition of the perfect model of justice is founded on an original utilitarian analysis which employs elements which anticipate the marginalism of the next century; to increase both the level of national welfare and the civic participation the laws have to improve the position of the least advantag…
2015
From December 1840 to May 1841, the deliberations of the “Broglie Commission” (Commission des affaires Coloniales) were about the problem of colonial representation. The Commission presented a draft proposing the abolition of the colonial councils in the four French colonies and the colonial delegates for the King’s government. In substitution, every colony would have had a general elective council and its organization would have been established by royal ordinances in the form of procedures of the Public Administration. Despite the important work, the Commission failed to produce the desired results because of the opposition of landowners and colonies who wanted to preserve their «specific…
2009
This article presents some considerations about Paolo Pastori's book "Alla ricerca di un ordine nuovo". It analyses the period between 1759-1821 and it exceeds some schematisms on historiographic reconstructions proposing new interpretations. This article, in particular, pays attention to the constitutions during 1791-1812 and shows the American constitutional mortage, as well as the reciprocal influences on French and Italian constitutions elaborated from the outbreak of The French Revolution to the Restoration period.
Rawls ed An-Na’im in dialogo. Reciprocità, Islam e Costituzionalismo
2018
Constitutionalism and Islam are the theoretical framework of An- Na’im’ Islamic reformation. This proposal is possible on the herme- neutic role of the naskh for a new interpretation of the Qur’an and Sunna, based on the principle of reciprocity. Is the An-Na’im’s notion of civic reason a ‘friendly amendment’ to Rawls’idea of public reason? Making sense of the reciprocity and the reasonable as normative and moral ideal in the two thinkers, through the necessary dimension of the constitutionalism, can overcome their differences.
