Il riconoscimento civile dello scioglimento canonico del matrimonio non consumato e l’attuale regime pattizio: spunti per un ripensamento (in vista d…

2019

The Concordato lateranense, as modified in 1984, no longer includes a provision on the recognition of the civil effects of dispensations super rato: and this is mainly due to political-ideological constraints which affect both the (bilateral) path of revision, and the concurrent intervention of the Constitutional Court (decision No. 18/1982) which endorses (while negotiations were still ongoing) the theory underpinning those constraints (the State’s ‘domination’ over the regulation of the marital relationship), while examining the super rato procedure in a formalistic way and stating that judicial protection is not sufficiently guaranteed. Firstly, the present paper deals with the origin, t…

This work analyzes the reform of article 135 of the Spanish Constitution which was introduced in September 2011, from the perspective of the constitutional principles as well as the decisions taken by the Constitutional Court. The focus is mainly on the analysis of the procedure followed to conduct the reform, which –it was said—severely breaks the constitutional consensus.

W sprawie zgodności z Konstytucją RP powoływania sędziów – członków Krajowej Rady Sądownictwa przez Sejm

2022

Przedmiotem niniejszego tekstu jest ustalenie, czy art. 9a ustawy o Krajowej Radzie Sądownictwa jest zgodny z Konstytucją RP. W celu udzielenia odpowiedzi na to pytanie przeanalizowano relacje, jakie powinny panować pomiędzy poszczególnymi władzami w systemie opartym o zasadę podziału władz.

Informal Constitutional Changes in Romania

2015

Constitutional change has been one of the most interesting debates in the recent constitutional law scholarship. A distinction has been drawn between formal and informal constitutional changes, by using as a criterion the compliance with the requirements of the constitutional text regarding constitutional change. Usually, informal constitutional change is determined by various factors, among which the lack of clarity or the extreme rigidity of the Constitution. Constitutional Courts are among the authorities who are frequently responsible of making informal constitutional changes. The present article comprises a brief introduction on the differences between formal and informal constitutiona…

The Constitution of Latvia – A Bridge Between Traditions and Modernity

2019

The Latvian constitutional system is based on the principle of State continuity after the Soviet occupation, and this is reflected in the reinstatement of the 1922 Constitution (Satversme). Unlike other constitutions in the post-communist area, it is characterised as a laconic and predominantly procedural constitution. However, important amendments were introduced in 1996 and 1998, establishing the Constitutional Court and introducing a catalogue of fundamental rights. The constitutional culture has been influenced by German traditions in constitutional jurisprudence, and the adjudication of legislation on substantive grounds has been stringent. This is particularly evident in the annulment…

Historical Overview of the Romanian Constitutionalism

2011

The history of the Romanian constitution and constitutionalism is closely linked to the 19th and 20th centuries. The 19th century meant the birth of the national unitary Romanian state and the building of the modern constitutional system by way of the massive constitutional transplant from the Western constitutional models. Breaking with the past was abrupt therefore just few ideas, institutions and practices remained as an organic linkage with the political and constitutional past.

Somali Contract Law: Constitutional and Comparative Perspectives

2019

The Somali legal system had a very peculiar development. After colonisation, the independent country adopted a Civil law based legal system largely influenced by Italian law. The Civil Code adopted in 1973 was modeled on the Egyptian homologue enriched with other influences, mainly Italian. From the constitutional perspective, the country had three constitutions before the collapse of the state, followed recently by a provisional constitution that introduces a federal system to try to keep the unity of the State under the federal umbrella. The 1973 Somali Civil Code is formally still in force, as after the fall of Siad Barre the state failure brought with it the lack of any authority capabl…

La genitorialita` procreativa nella coppia omoaffettiva (femminile). Riflessioni a margine di Corte cost. n. 221/2019

2020

2019

In two judgments delivered in 2018 (No. 120 and No. 194), the Constitutional Court for the first time referred to provisions of the European Social Charter as an interposed norm in the constitutional review of primary laws. The two judgments, however, leave two questions open. First, in judgment No. 120, the Court recognizes taht the European Social Charter may complement Article 117, paragraph 1, of the Constitution, as it constitutes a natural integration of the European Conventionof Human Rights on the social level, which in fact distinguishes it from "ordinary" international agreements. In its subsequent judgment No. 194, on the other hand, the Court speaks of treaties with constitution…
