The Russian president, Vladimir Putin, has emphasized the idea that the state should be a leading actor in post-Communist reconstruction. This chapter argues that constitutionalism, in the narrow meaning of the rule of law in the political process, coexists with a mildly authoritarian, state-oriented presidential regime such as the Russian Federation under Vladimir Putin. In Russian discourse, political reconstruction has been seen as cynical ‘political technology’ and Putin’s way to power is the primary example of such a kind of technology. In Bolivia, the third term and the habilitation of former President Evo Morales to the 2019 presidential elections was allowed with the acquiescence of the Plurinational Constitutional Court. Despite the fact that the Constitution prohibited it and there was a referendum that rejected indefinite presidential re-election. This occurred through the judicialization of politics that produced a non-formal reform of the Constitution producing a case of abusive constitutionalism and the destabilization of the rule of law.

The paper aims to reconstruct the doctrinal evolution of the juridical thought in the transition from liberal constitutionalism - identifiable with the nineteenth-century theories of the "rule of law" - to democratic-social constitutionalism that inspires and shapes the "Welfare State". In short, democratic-social constitutionalism can be viewed as the fundamental core of the social pact through which the European and Western civilisation manages to provide a democratic alternative to the disintegration of the liberal states. The main features of the new constitutionalism will be analyzed by focusing on what, in our opinion, can be considered its main “pillars”.

The history of the Romanian constitution and constitutionalism is closely linked to the 19th and 20th centuries. The 19th century meant the birth of the national unitary Romanian state and the building of the modern constitutional system by way of the massive constitutional transplant from the Western constitutional models. Breaking with the past was abrupt therefore just few ideas, institutions and practices remained as an organic linkage with the political and constitutional past.

RESUMEN. La teoría de los derechos fundamentales de Robert Alexy se fundamenta en un concepto material de norma jurídica que es de carácter doble. Por un lado, se define por los rasgos propios de los principios, en consonancia con la idea de argumentación correcta. Pero, por otro lado, sigue teniendo peso la validez jurídica de las normas que contienen derechos fundamentales, consideradas como reglas constitucionales.
