Constitucionalismo democrático e innovación constitucional en Ecuador

2021

2018

The origins of the Italian Public Administration date back to a time prior to the political birth of Italy. Its history follows an itinerary based on gradual modifications in correspondence with economic, social, political and cultural changes. Between the 19th and the 20th Century, the Italian Public Administration played several roles. Going from being a political instrument to a means of social intervention and/or a vehicle of economic direction, the Italian Public Administration drew its own structures and modified its own roles, according with the constitutional development that leaded Italy from the liberal State to the fascist State. But there was also a technical continuity, which p…

The two faces of Nordic management? Nordic firms and their employee relations in the Baltic States

2009

This study examines Nordic management styles in union and non-union industrial enterprises in the Baltic States (Estonia, Latvia, Lithuania) through case studies of nine Nordic subsidiary companies, based on on-site interviews with management and employees.1 This analysis construes the ‘Nordic model’ of management style as ‘bargained constitutional’ or ‘sophisticated consultative’, following Purcell and Ahlstrand's (1994) matrix of management styles in the highly unionized countries of origin, characterized as coordinated market economies. The case studies reveal that in the Baltic liberal-market environment, Nordic employers exhibit a variety of management styles, ranging from sophisticate…

IL COSTITUZIONALISMO VITTORIANO TRA LIBERTÀ E IMPERO

2020

Victorian constitutionalism carries out the political premises of the Glorious Revolution, enshrining the definitive transition from the constitutional monarchy to the parliamentary one: the choice of the Prime Minister is taken away from the royal prerogative and determined by the confidence of the elective chamber, to which the Cabinet is responsible. Historical precedents, which are sometimes fortuitous, have codified a practice that would have been a model for western constitutionalism. And this is in spite of the contradictions of an era that takes its name from Queen Victoria, in which a vast colonial empire is the other side of the coin of domestic freedom, and in which poverty and e…

A Failed Constitutional Experiment: The Monarchical Constitutionalism and the Organic Regulations of 1831-1832

2020

In this paper I intend to give a brief account of the context, causes, structure, aims and dynamic of what I decided to label the Romanian ‘monarchical constitutionalism without octroy’, as a subspecies of the monarchical constitutionalism. After a short account of the geopolitical, political, legal and social contexts specific to the Romanian Principalities at 1830, I shall address the provisions of the ORs against the accepted standards of the monarchical constitutionalism and follow their subsequent developments in the Romanian constitutional and political praxis. My core idea is that the Russians have borrowed from France and imposed the specific constitutional mechanisms of limited mon…

The State Power and the Limits of the Principle of Sovereignty: An Historical Approach

2012

This chapter explores the notion of sovereignty and the limits of state power in the framework of criminal justice. It is not an easy enterprise to counter terrorism while respecting the rule of law and guaranteeing the security of citizens to the maximum extent possible without violating their fundamental rights. Theoretically, modern constitutionalism emerged to protect citizens from political abuses of power. In practice, however, fundamental rights are not always fully respected since the state is often tempted to exercise its power beyond legal boundaries. To limit the power of the state means to limit its sovereignty. Otherwise, the abuses of power by the state become inevitable. Surp…

Le constitutionnalisme octroyé - itinéraire d'un interconstitutionnalisme au XIXe siècle (France, Portugal, Brésil)

2019

This book could have been a simple history of constituent power in the 19th century, in countries that experienced the return of the king after tumultuous revolutionary episodes. It is, in part; the reader will find in it the legal and political debates on this question during the periods of contestation of national sovereignty in three deliberately selected countries: the Bourbon Restoration for France; the tumultuous monarchy of Portugal, from the granting of the constitutional Charter in 1826 to its fall in 1910; the Empire of Brazil, since the independence. However, we thought it would be useful to propose something else, by shedding new light on the little-studied phenomenon of granted…
