The Code of Criminal Procedure of 1928 provided three types of jurisdiction: material, topical and functional. In general, legal solutions adopted in the Code including provisions on material jurisdiction should be viewed positively. The regulations covered all the cases the Polish courts could hypothetically come across in practice, procedurally solving many issues connected with it. The most important cases included: the invalidity of judgments issued by the improper court, the jurisdiction of the magistrates courts, the determination of the topical jurisdiction of the courts, the aggregate consideration of cases, and resolving conflicts of jurisdiction between common and military courts.…

The article aims to deepen a fundamental and much debated profile in relation to the special rite of the Italian patteggiamento. In particular, the Author, in the light of an analysis of the undoubted particularities of the judicial mechanism of application of penalty upon request of the parties, intends to focus on the essence and the operation that the judgment rule assumes, respectively, in the ordinary cursus of criminal proceeding and in therevision, trying to offer an interpretative reconstruction that is able to reconcile the (substantial) needs of justice and the (formal) reasons for systematic coherence.

The current thesis focuses in one of Spain’s most relevant authors: Pedro Dorado Montero. Acting as a bridge between the criminal law conceptions of the 19th and 20th centuries, Dorado Montero offered a very unique, original theory: the ‘Derecho protector de los criminales’ (Protective Law of the Criminals).
