The Criminals in Vilnius

On 29 April 1930, the premiere of Ferdinand Bruckner’s The Criminals (original title Die Verbrecher) directed by Aleksander Zelwerowicz took place at the Teatr Wielki na Pohulance in Vilnius. After two performances, the play was cancelled by the mayor of Vilnius. The authorities of the city were outraged by the ‘drastic amoral scenes (homosexual love, abortion)’. Zelwerowicz submitted his resignation, which he withdrew a few days later. A performance combined with a debate on the drama was organised. l contributo analizza l’impatto che il recente inserimento dell’ambiente in Costituzione può dispiegare in ambito penale, tanto rispetto all’ambiente quale oggetto della tutela penale, quanto sul versante della selezione dei modelli di illecito, soffermandosi in particolare sul problema delle possibili ricadute penalistiche del nuovo vincolo di solidarietà ecologica di tipo intergenerazionale. Seguendo il fil rouge del bene giuridico, la seconda parte del saggio ricostruisce invece i punti critici e le prospettive di sviluppo del diritto penale ambientale internazionale, alla luce della nozione di ambiente quale bene giuridico comune ed universale.

The paper analyses the impact that the recent inclusion of the environment in the Italian Constitution may have in the criminal law both with respect to the criminally relevant notion of the environment and with regard to the selection of the types of criminal offences. From this point of view the paper also takes into consideration the penal significance of the new bond of intergenerational ecological solidarity. The paper analyses the relationship between the criminal treatment of 'soft' drugs and the fight against organised crime related to drug trafficking with regard to European law international law and national criminal law of some EU countries (Spain Portugal Greece Germany and Italy). Following an integrated approach the analysis is carried on taking into consideration the phenomenology of trafficking and an assessment of the initial effects that the anti-prohibitionist reforms of some North and South American jurisdictions have produced on the illicit market. Aim: Italian criminal groups become more and more dangerous spreading their activities into new sectors. A criminal group is made up of networks of hundreds of family gangs which extended their influence across the world, raking in billions from drug trafficking, extortion and money laundering. We focus in particular on the analysis of the social structure of two Sicilian crime families and we used a Social Network Analysis approach to study the social phenomena.
