The article describes the limits that the law formally assigns to collective bargaining in the matter of public managers’ liability before focusing on an analysis of the effects that contractual regulations have produced (and produce) in the general field of the allocation, revocation and renewal of senior positions. Based on this survey, the paper highlights the inconsistencies of some (both interpretative and de iure condendo) proposals, generally shared by a majority of scholars.

La sentenza della Cassazione 23 marzo 2017 n. 7551 ribadisce il principio che la natura demaniale marittima di un terreno non può essere esclusa se non in forza di un provvedimento amministrativo. Non può pertanto il giudice sostituirsi all’amministrazione in tale valutazione discrezionale. The judgment of the Supreme Court (n° 7551/2017) reiterates the principle according to which the public maritime nature of an area can not be excluded except by virtue of an administrative decision. Therefore, the judge can not substitute the administration for this discretionary assessment.

In the light of the approval of Bill No. 50/2016, availment is one of the most problematic institutions in terms of application. The aim of this work is to examine the innovative contributions, relative to the indication of resources covered by the contract of availment; the function and the nature of the supportive responsibility of the auxiliary firm with regard to the Public Administration; the principles of modifiability of the auxiliary firm, to highlight all critical profiles currently in force.
