Il saggio esamina la questione dell'assegno di divorzio nella prospettiva della solidarietà post-coniugale, analizzando criticamente l'esito di cripto-indissolubilità del matrimonio che emerge dalla consolidata lettura della relativa obbligazione come tendenzialmente priva di termine finale. The essay examines the issue of the divorce allowance from the perspective of post-marital solidarity, critically analyzing the outcome of the crypto-indissolubility of marriage that emerges from the consolidated reading of the relative obligation as tendentially without a final term.

Prenuptial agreements are legal settlements by which a couple who is about to get married can establish the terms of the respective assets and economic interests during or after the dissolution of the marriage. The enforceability of such agreements, however, requires a delicate balance between the will expressed by the parties, on the one hand, and the public interest related to family, on the other. The comparison between US, English and Italian family law on that issue will clearly show that, both in common law and civil law countries, the concepts of status familiæ and private autonomy can coexist if they are observed in the light of the highest value of human dignity.

The Effect on Health of Marital and Cohabitation Status

Researches on the consequences of divorce on health are scarce in Spain. This study is a contribution to this field from sociology and demography. In it, the health of separated/divorced Spanish men and women is analyzed using the European Health Survey 2009-2010. Employing questions on perceived health and objective mental health, we explore whether 1) people with divorced or separated marital status suffer from poorer health than married; if 2) the cohabitation with a partner promotes a better health; and if 3) gender is a source of health differences between divorcees.
