1400 years of man-environment interactions and soil evolution in the Saint-Mont mountain (Remiremont, Vosges)

International audience; The SolHoM(a) project aims at determining the degree of landscape anthropisation in the Fossard massif (Remiremont, Vosges, France) by estimating the impact of past human occupations on current soils. Nowadays, a forest covers this relatively inhospitable mountain (hard climate, steep slopes, acid soils ...), but some remains suggest human presence for at least 1400 years.The Saint-Mont is a variscan orogenic granitic summit (height 672m) with valuable preserved archaeological relics, located south of the Fossard. Nel contributo in oggetto l'autore, muovendo dalla decisione delle Sezioni Unite della Cassazione n. 61 del 7 gennaio 2014, coglie l'occasione per riesaminare le vecchie e nuove problematiche sottese all’intervento dei creditori nel processo esecutivo. Il primo tema affrontato è quello della par condicio creditorum, che viene esaminata nella sua storia evolutiva dal Code Napoleon, al suo periodo di massima estensione, dato dal codice del 1940, fino al suo ridimensionamento a seguito delle riforme del 2005. It concludes however that a revolution like the aforesaid explained would be only apparently advantageouOld and new problems related to the intervention of creditors in the expropriation (marginal notes at Cass. Sez. Un. January 7 2014 n. 61) Moving from the decision of the Sezioni Unite n. 61/2014 the author takes the opportunity to re-examine old and new problems related to the intervention of creditors in the forceable execution. The first major theme concerns par condicio creditorum which is examined in its evolutionary history since the Code Napoleon through its period of maximum extension (the Code of 1940) until its reduction as a result of the reforms of 2005. The author examines the possibility to overcome quoad effectum the distinction between sine titulo et cum titulo interveners in light of jurisprudence’s evolution between 1978 2009 and 2014. The possibility in particular concerns those creditors sine titulo the where credit has not been contested (ex art. 499 c.p.c.) by the debtor seek payment and partecipate to distribution. In the last section the author examines the possibilities for other creditors to contest the intervention of the creditor sine titulo ex art. 499 c.p.c. (utendo iuribus in subrogation in case of inaction of the debtor) or in the distribution phase ex art. 512 c.p.c. He concludes that the only person that will be really damaged if he doesn’t contest - ex art. 499 c.p.c. - the credit it is precisely the debtor. Due to the wide extension of the country and to the shortness of the ice-free season, the inlandwater crustacean fauna of Mongolia is, to date, incompletely known. However, based on the available literature, Mongolian inland waters appear to be characterised by a high biodiversity, including some taxa still waiting to be described. Novel data on the branchiopod, copepod, and ostracod crustaceans from central Mongolian steppe, from the “Tuul” and “Umard goviin guveet-Khalhiin” hydrographical basins, are presented herein. The density and movements of fish under ice were studied with single-beam mobile surveys and fixed location split-beam surveys, as well as exploratory fishing in winter-seining areas of two shallow Finnish lakes during winter 1999. Fish schooled near the bottom during the day but the schools dispersed and fish ascended at night. Single and split-beam target strength distributions corresponded fairly closely with the length distribution of seine catch samples. Estimated fish densities were greater at night than in daylight.
