IL PIANO DEL CONSUMATORE SOVRAINDEBITATO: TENTATIVI DI RIFORMA E PROSPETTIVA EUROPEA

Social Inclusion and responsible lending seem to became the main policy roots along which a new regulatory framework for households credit and particularly for consumer credit is being shaped at Europeanlevel;throughtheinterplaybetweenthetwo,non-economic goals such as fighting poverty spread and promoting social cohesion can be combined with properly economic ones, such as the systemic risks prevention arising from weak credit access filter mechanism. In his contribution on “Rights, balancing and certainty,” Aldo Schiavello analyzes the legal measures taken by Italian public authorities to contrast the virus, by focusing on indeterminacy as one of the main characteristics of the law in contemporary constitutional States. According to the author, the ways in which the legislator, at different lev…
The Right to Health and Resource Allocation. Who Gets What and Why in the COVID-19 Pandemic
2022
The COVID-19 outbreak has led to a worldwide, substantial increase in the demand for pharmaceuticals, hospital beds, ventilators, and medical supplies. When needs suddenly exceed demand worldwide, resources may quickly become scarce with potential demand, so that strict rationing is the only viable response. Against this backdrop, this chapter scrutinizes the rationales for the prioritization of scarce resources. It questions the essential role and reaches the market concerning resources essential to delivering health care, especially in severe shortages, such as during a global pandemic.
