Diverse sembrano essere le posizioni assunte dalla Corte Europea dei Diritti dell'Uomo e dalla Corte di Giustizia dell'UE. La prima sembra imporre agli Stati l'estensione dell'istituto matrimoniale alle coppie di uguale sesso, indipendentemente dalle consolidate caratteristiche costituzionali di ciascuno Stato. La seconda, in sintonia con il suo ruolo, assume una posizione più rispettosa delle identità costituzionali nazionali.

The book shall analyse the moral suasion of the President of the Republic, with a particular regard to informal relationships with the Parliament and Government, both political institutions in the Italian legal order. In particular, the monograph focuses on the analysis of the different instruments underpinning moral suasion, as well as their effects and implications on the President’s formal powers of control, constitutional guarantee, and those related to political decisions under articles 92 and 88 of the Constitution. The overall aim of the book is to highlight the interconnection between the President’s influence activity and his role and figure in the Italian form of government.
