Hate Speech e messaggi discriminatori: riflessioni internazionalistiche sul caso Casapound c. Facebook

In this intervention the idea is submitted that the interim measures in the case Casapound v. Facebook, by means of which Fb Ireland was ordered by the Rome Tribunal (on December 12, 2019) to reactivate the profile of the extreme right wing political association Casapound - previously closed as a consequence of an alleged violation of fb standards concerning hate speech - can be criticized under international and european law. Such criticisms stem both from the overall picture of the international and european legal standards concerning hate speech (par. 2) and from the relevant case law of the European Court of Human rights (paras. 3 and 4).

Il presente articolo analizza gli elementi giuridici e politico-strategici del famoso caso di biopirateria della Hoodia gordonii. Il caso è normalmente citato come esempio di successo della collaborazione tra case farmaceutiche e comunità indigene in merito all’utilizzo delle conoscenze tradizionali. Sulla base di ricerche bibliografiche e sul campo, il testo ne descrive lo svolgimento e ne svela alcuni dei non pochi e spesso tralasciati lati oscuri, domandandosi non solo se sia necessario metterne in dubbio il tanto professato successo, ma anche se l’attuale regime giuridico per la protezione delle conoscenze tradizionali sia adeguato ed efficace.

L'articolo esamina il contributo della Corte europea dei diritti umani ai processi di transizione democratica con particolare attenzione ai Paesi dell'Est europeo. Dall'analisi della giurisprudenza della Corte non emerge una visione unitaria del concetto di "transizione democratica", che viene in rilievo talvolta come un fatto, altre volte come un valore. La stessa "transizione - valore", poi, non è concepita in temini unitari, dato che la democrazia può essere intesa come "aperta" o come "militante". Il contributo si propone, pertanto, di comprendere se nella giurisprudenza della Corte sia possibile riscontrare, se non altro, la ricerca di un punto di equilibrio tra queste diverse nozioni.

This paper contributes to the existing literature by investigating the scope of States’ obligations to realise women’s rights and ensure gender equality amid the COVID-19 pandemic.
