This master thesis is a qualitative narrative inquiry that illustrates and explores the stories of five visually disabled participants who took up the practice of rock climbing and mountaineering as a means to overcome social inequality. The researcher’s role within the study was that of active participation by being the coach and mountain guide for the participants over a period of five years. The paper analyzes the evolution of sporting activity for disabled people, focusing in particular on the problems concerning the performance of risky sporting activities by people with mental disabilities; these problems per- tain to the relationship between the protection of health understood as the interest of the community and the protection of health understood as the right to the pursuit of happiness, which also involve the question of the limits to the acts of disposing of one's body, and which are resolved through a continuous dialogue between the sports system and the state system.

Objective: Disabled people have the same right as other people to receive the health care they need, but they sometimes have difficulties to achieve it. In Castilla y Leon it has come into effect a law to guarantee Primary and Secondary Care coordination to provide dental treatment under sedation or anaesthesia to mentally disabled people who need it. Tässä tutkimuksessa tarkasteltiin, miten lasten syntymän jälkeen vammautuneet äidit rakensivat identiteettiään äiteinä vammautumisensa jälkeen. Tutkimusaineisto koostui viiden vammautuneen naisen haastatteluista, jotka analysoitiin narratiivisesti. Vammautuneiden äitien kertomuksista löytyi neljä kerronnallista jännitettä, joiden kautta he rakensivat äitiysidentiteettiään: 1) merkityksetön vai merkityksellinen elämä, 2) lapsen rakkauden menettäminen vai äidin ensisijaisen aseman säilyttäminen, 3) kyvyttömyys toimia äitinä vai äitinä selviytyminen sekä 4) riippuvaisuus lapsesta vai hoivan antajana toimiminen. Przedmiotem glosy jest wyrok Naczelnego Sądu Administracyjnego z 8.01.2020 r., I OSK 2392/19, w którym przyjęto tezę, że art. 17 ust. 5 pkt 1 lit. a ustawy o świadczeniach rodzinnych prawidłowo zinterpretowany powinien być w ten sposób rozumiany, iż pozbawia prawa do świadczenia pielęgnacyjnego tylko do wysokości otrzymywanej emerytury. Teza tego wyroku jest całkowicie sprzeczna z treścią przywołanego przepisu.
