This article provides for an overview of some relevant developments in the case-law of the ECtHR in 2020. Priority will be given to Grand Chamber judgments and decisions and those of the Chambers deemed to be relevant from a substantial and procedural viewpoint. The paper analyses different remedies used by the Supreme Court to execute judgments of the ECHR in the Italian system. Indeed, the solution adopted by the Constitutional Court - based on the revision - was not satisfactory. Lastly, the Cartabia reform has inserted in the criminal procedure code a new remedy under the competence of the Supreme Court that will pose some practical issues.

The essay deals with safeguarding the right to a healthy environment in the Italian and English systems, especially for the individuals affected by emissions that corrupt the air quality interfering with their private and family life. The study focuses on the injunction, as a non-compensatory remedy, actionable before the English courts by claimants seeking the decontamination of the polluted areas. The insight into the foreign environmental law will provide a new perspective on the Italian one that (as the European Court of Human Rights stated in the Cordella case) does not secure everyone an effective remedy to the violation of their environmental human right.

In this brief intervention it is submitted that the emergency measures against COVID-19, adopted by the Hungarian Government, infringe the rule of law under the European Convention of Human Rights. First of all, these measures appear to be discriminatory, according to art. 1 of the Convention, insofar as they expressly aim at protecting only Hungarian citizens. Furthermore, they are not “necessary” under article 15, given that they extend to the « legal security and the stability of the national economy ».
