Glosa dotyczy uchwały Naczelnego Sądu Administracyjnego z dnia 22 lutego 2021 r., sygn. akt I OPS 1/20, która stanowi, że: „Odszkodowanie, o którym mowa w art. 36 ust. 1 ustawy z dnia 12 marca 1958 r. o zasadach i trybie wywłaszczania nieruchomości (Dz. U. z 1974 r. Nr 10, poz. 64 ze zm.), może być od dnia 1 stycznia 1998 r. ustalone na podstawie art. 129 ust. 5 pkt 3 ustawy z dnia 21 sierpnia 1997 r. o gospodarce nieruchomościami (Dz. U. z 2020 r. poz. 65 ze zm.) dla spadkobiercy właściciela nieruchomości wymienionej w art. 35 ust. 1 ustawy z dnia 12 marca 1958 r. o zasadach i trybie wywłaszczania nieruchomości”.
