The Founding Fathers did not realize the full extent of the rift between classicism and modernity. La sentenza n. 116 del 2010 della Corte costituzionale segna un significativo passaggio nella determinazione dell’assetto dei rapporti Stato - Regione Siciliana, comportando un considerevole arretramento dell’esercizio dell’autonomia tributaria e finanziaria di quest’ultima. The separation of powers and responsibilities has evolved over time in Italy given that political ideals have been pushing towards a greater decentralization for the last twenty years. Under environmental federalism issues, an interesting case of study - capable of being empirically treated - is the attribution of power to the Regional governments over the management of mining and quarrying. L'attuazione del c.d. federalismo fiscale nell'ordinamento italiano, partire dalla riforma costituzionale del titolo V della Costituzione, fino all'approvazione della legge delega n. 42/2009, costituisce un percorso ancora in fieri.
