In 1994 Ethiopia has adopted a new constitution, considered one of the most advanced in terms of provisions for human rights. The progressive ratification of several international treaties on minority rights had already begun in 1991, immediately after the fall of the Derg regime. This progress has brought Ethiopia into the UN monitoring system, but the review of the official UN documents reveals the mismatch between the mentioned constitutional and international steps and the on-ground situation. The recent evolution of the Spanish ‘State of Autonomies’ has given rise to numerous political and academic criticisms, which argue that the initial federal logic of the system is giving way to a confederal logic that threatens the cohesion of the state. This article contradicts the negative diagnosis, outlining the main mechanisms that retain and in fact reinforce the powers of federalization in tandem with the fundamental political decentralization process that has taken place since 1978. La sentenza n. 116 del 2010 della Corte costituzionale segna un significativo passaggio nella determinazione dell’assetto dei rapporti Stato - Regione Siciliana, comportando un considerevole arretramento dell’esercizio dell’autonomia tributaria e finanziaria di quest’ultima. Le statuizioni espresse dal Giudice delle leggi, al di là delle peculiarità proprie dello speciale regime fiscale della Regione, rivestono grande rilevanza in generale anche per l’attuazione del c.d. federalismo fiscale nel nostro Paese.

The separation of powers and responsibilities has evolved over time in Italy given that political ideals have been pushing towards a greater decentralization for the last twenty years. Under environmental federalism issues, an interesting case of study - capable of being empirically treated - is the attribution of power to the Regional governments over the management of mining and quarrying. L'attuazione del c.d. federalismo fiscale nell'ordinamento italiano, partire dalla riforma costituzionale del titolo V della Costituzione, fino all'approvazione della legge delega n. 42/2009, costituisce un percorso ancora in fieri. L'autonomia finanziaria e tributaria delle regioni, con notevoli differenze ancora tra quelle ordinarie e speciali, non pare abbia trovato compiuta definizione, tra limiti interni e comunitari.
