Ermeneutica giuridica e pluralismo

The traditional theory of legal interpretation has been worked out with reference to culturally homogeneous societies and on the basis of priority of domestic law.Nowadays both of these conditions has been vanished, because of cultural and legal pluralism. In this paper I aim to show that legal hermeneutics can cope with the problems that have been risen by contemporary pluralism. The main difficulty stems from the fact that philosophical hermeneutics too seems to necessarily require a kind of cultural homogeneity and steadiness that cannot be presupposed anymore.

The paper deals with the structural vagueness of the legal measures enacted by the Italian legislator to manage the Covid-19 pandemic. Can we demand more certain norms? Is personal liberty taken in due account by the legislator? Starting from these and similar questions, the paper proposes a reconstruction of the law and of the underlying legal ideology of contemporary constitutional States.

This entry is devoted to a survey of the main analytical conceptions of legal science. The focus will be in particular on (1) Alf Ross’s legal realism and his neo-positivistic approach to legal science; (2) Norberto Bobbio and the Italian analytical legal philosophical school, which firmly tie legal science to language analysis; (3) Herbert Hart and the analytical philosophy of ordinary language, and, eventually, (4) Ronald Dworkin and the interpretative turn.

This paper offers a diachronic reconstruction of MacCormick’s theory of law and of legal argumentation; in particular, two connected points will be highlighted in which the difference between the perspective upheld in Legal Reasoning and Legal Theory and the later writings is particularly marked. The first point concerns MacCormick’s gradual break with legal positivism, and more specifically the thesis that the implicit pretension to justice of law proves legal positivism false in all its different versions. In this article I will explain the content of soime cognitive bias and the content of liberal theories. I will argument that people commit less cognitive errors than Conly and others think. Secondly, some behaviours that Conly and others think are cognitive bias are not. Finally, it is clear in the studies of Kahneman and Tversky that the majority of cognitive bias are not incorrigibles (in the correct sense of this word)

Liberty and Equality as the Morality of the Rule of Law

After presenting a schematic map of the concepts at stake (liberty, equality) in so far as they are relevant for the general topic (their relationship with rule of law – from now on RoL), and after examining different forms of their relationships, this entry focuses on the specificity of the relationship between liberty and equality in the legal context. The title suggests that a combination of liberty and equality is the very basis of every legal system inspired by RoL. This circumstance requires the identification of different versions of the idea of RoL.

Piazza riflette sui rapporti tra violenza e linguaggio usando come ambito di indagine l’Iliade. La scelta – azzeccata – è supportata da tre ragioni. Innanzitutto l’Iliade è «[…] il racconto di una guerra che ha acquistato nei secoli […] il sapore di una guerra archetipica e ha svolto il ruolo di fonte inesauribile del nostro immaginario, non solo poetico» (p. 41). Inoltre, la società narrata nei poemi omerici è caratterizzata dalla competitività e dalla ricerca della vittoria, da ottenersi sia attraverso la forza fisica sia attraverso la capacità argomentativa.
