Sulla base della documentazione manoscritta, anche inedita, e di altre fonti si ripercorrono le vicende che portarono nel 1816 Barthold Georg Niebuhr a scoprire il palinsesto delle Istituzioni di Gaio nella Biblioteca Capitolare di Verona e si discute criticamente la casualità di tale scoperta.

In the archives of the Berlin-Brandenburgische Akademie der Wissenschaften two letters by Barthold Georg Niebuhr of September 1816 are preserved which have never been published in a scholarly edition. The present transcription of the text is diplomatical. Furthermore the letters are examinated in their historical context. The use made of these letters in an anonymous publication in the same year in the Allegmeine Literatur-Zeitung is also discussed.

This paper discusses the idea that the gap regarding the dowry in Gaius’ Institutes is due to the fact that Gaius intentionally did not deal with this subject because he considered it as 'ius singulare' and that this omission was filled in by a 'liber singularis' outside the Institutes. The existence of a "didactic system" made up of the Gaius’ Institutes and four 'libri singulares' for the classical age of Roman Law is also disputed.

The contribution deals with the origin of the particular place assigned in the Paraphrase of Theophilos to Obligations in relation to the Institutional System ‘personae-res-actiones’. The Author suggests that the displacement of Obligations from the field of the res to the field of the actiones and the representation of Obligations as “mothers of actions”, instead of deriving from an existing idea of Theophilos or from a general byzantine view, is influenced by some passages of the Justinian’s Institutions.

The text of Gaius’ Institutes concerning the price of a sale contains a curious peculiarity. Gaius first of all reports the requisites of the price in the form of peremptory rules, but soon afterwards he indicates as consequence (nam...) a contrast of views: some jurists admit the relevance of a sale which doesn’t observe these requisites.
