Mating strategies and resulting patterns in mate guarding crustaceans : an empirical and theoretical approach

Because of strong costs associated with each mating event, females are usually not as available for reproduction as males at any given time. Males are therefore in competition with each other for access to receptive females, hence leading to strong sexual selection. One textbook case of such a mating system occurs in moulting crustaceans where females can only be fertilized during a short period following their moult. This has favoured the evolution male strategies to monopolize females before their period of receptivity. With a courageous judgment, the Constitutional Court extends the application scope of art. 25, par. 2, Cost. in the criminal enforcement sector. Censoring the living law, the Court states the prohibition of the retroactivity of the measures more afflictive introduced by law no. 3 of 2019 to convicts who committed the fact before its entry into force. The Author, after dwelling on the new paradigm of "European legality", retraces the salient passages of the decision, from which it draws the innovative message of the Judge of the laws.

Abstract One of the measures employed to protect an individual is guardianship. Legal norms treat guardianship aimed at protecting a person with full capacity of exercise in certain special situations in a different way than they do guardianship for minors or persons placed under interdiction. While guardianship for capable persons is governed by the rules of mandate, guardianship for minors and persons placed under judicial interdiction are subject to rules applicable to custody for minors (art. 171 of the New Civil Code).
