The Introduction of the “Balanced Budget” Principle into the Italian Constitution: What Perspectives for the Financial Autonomy of Regional and Local…
2013
This paper analyses the impact on regional and local authorities of Articles 117 and 119 of the Italian Constitution as amended by Constitutional Law no. 1/2012. In particular, it attempts to verify whether the new formulation of these constitutional provisions materializes the risk of a significant reduction in the financial autonomy of both Regions and Local Governments. With the constitutional reform the legislative competence of “harmonization of public account” has become an exclusive State competence, the “balanced budget” principle has been extended to Regions and local authorities and public borrowing has been broadly prohibited. What is the actual significance of the changes introd…
Zur Identität der Strafrechtswissenschaft in der Mehrebenen-Rechtsordnung
2014
The general scenario of the contemporary multi-level legal system raises several questions for the criminal law science, ranging from the relations between national and supra-national sources of law, to the interaction between different courts that, however, equally play a role in the protection of fundamental human rights. These new kinds of relationships among different legal sources and different courts are governed by new forms of mutual influence and interaction which are largely different from the traditional, deductive, mainly hierarchical, approaches. Upon clarifying the significance and the context in which these new relationships between the criminal law science and the multi-leve…
Biosystems Engineering curricula in Europe
2013
This paper describes the history of the harmonisation of agricultural/biosystems engineering degree study programs in Europe from 1989, when the need for this process was widely felt, until now, when this need was partly satisfied through the implementation of the projects of two EU funded thematic networks, i.e., USAEE-TN and ERABEE-TN. The objective of this paper is to contribute to promote, in each EU country and elsewhere, the process of harmonisation of agricultural/biosystems engineering degree study programs, and student and graduate mobility within the EU, as well as between the EU and the USA. At present, in Europe, this harmonisation process is aided by the key results of the proj…
L'identità della scienza giuridica penale nell'ordinamento multilivello
2014
State of the Art on Degree Study Programs in Agricultural/Biosystems Engineering in EU
2021
The process of international harmonisation of the degree study programs in Agricultural/Biosystems Engineering (ABE) was started by Prof. Giuseppe Pellizzi during CIGR 1989 Conference and was continued by Prof. Pierluigi Febo in EU, within EurAgEng SIG RD12 - Education and Communication, and also within CIGR WG1 - Agricultural Engineering University Curricula Harmonization. Then, four thematic networks were effective: 1) USAEE-TN (University Studies of Agricultural Engineering in Europe - A Thematic Network), comprising 31 HEIs (Higher Education Institutions) from 27 countries, from 2002 to 2006; 2) Consortium POMSEBES (Policy Oriented Measures in Support of the Evolving Biosystems Engineer…

The notion of Organised Crime in eu law
2017
The contribution consider, first, the original multiplicity of national legislative solutions with respect to the crucial issue of ‘punishability’ of criminal organisations; then, identify the common standards under european harmonisation legislation, along with their respective characteristics and problems, in order to finally assess the most recent situation and the effectiveness of EU action in this area. A more general consideration on the nature of harmonisation in this area serve as background: what is at stake is not so much a rule (of EU law), but rather an actual principle (of EU law). As such, it cannot be evaluated in absolute terms of success or failure, of either standards rigi…
