The legal system started to use the word “vulnerability” to provide protection in cases of abuse or need. Understanding the double face of vulnerability, as both universal and individual, may lead us to overcome the traditional liberal paradigm and its idea of indi-viduals independent and autonomous, and finally embrace an idea of legal subject based on his inherent vulnerability. The differences between these paradigms are evident in the fields of migration and human trafficking. This paper proposes to rethink the approach to migration starting from vulnerability.

The definition of “human trafficking”, adopted by the United Nations Protocol, clearly describes how the international community has outlined the concepts of victim and perpetrator. Despite the definitive effort made by this Protocol, the present chapter seeks to throw light on the fuzzy area existing within the rapport between vulnerability and proximity violence which makes the consensual exploitation of the victim by the trafficker possible as well as making it difficult to outline its contours in the courtrooms.

After the fall of the Communist regime, the Romanian population has decreased approximately 15%, due to the high level of labour migration. The migration of Romanians was even more intensified later on, after Romania has joined the European Union.
