The residence permit for third-country nationals who are victims of human trafficking: A double-face instrument between compliance strategy and prote…

2017

Purpose The aim of the present study is to explore institutional design strategies that promote compliance by regulating peculiar sorts of agents, namely, human trafficking victims, starting from the point of view that institutions assume addressee virtue, but instead should consider the hypothesis of non-compliance or that the measures adopted reveal their inefficiency to satisfy the goals they were thought for, or that they are applied to obtain scopes, which are different from the ones they were conceived for. Design/methodology/approach Different methodological approaches, both deductive and inductive, are combined in the present paper, together with comparative and philosophical insig…

The political, legal and moral scope of the universal declaration of human rights: pending issues

2018

With the adoption of the Universal Declaration of Human Rights, a new era began in the recognition and guarantee of human rights in the international area. However, since the moment of its approval, this text has received negative evaluations designed to relegate it to the background. The responses to these criticisms allow us to review their political and legal scope, and put it in value as a reference model in the field of human rights, delving into the pending issues to strengthen it. This is intended, on the seventieth anniversary of the Declaration, to insist that this remains an essential bridge to clarify standards that can serve as a basis for discussion between different cultures a…

Derechos humanos y virtudes fundamentales

2013

2016

The 2013-404 law of 17 May 2013 which opened up the possibility for people of the same gender to get married shows a turning point for the family rights in France. This law, sometimes described as a real tsunami, is the outcome of taking into account the homosexuals' claim for starting a family. Before 2013 the French right did not allow a homosexual couple to be a homoparental family. It did not authorize people of the same gender to get married. Moreover Assisted Reproduction is only reserved to heterosexual couples and Gestation for Others is strictly forbidden in France. This seemingly constrained consensus on the non-legal recognition of the homosexual family is reinforced by the Europ…

2020

Equitable satisfaction was governed by Article 50 of the European Convention on Human Rights (ECHR) until the drafting of Protocol 11, which led to Article 41 governing the regime of fair compensation. Section 41 then reads: « If the Court finds that there has been a violation of the Convention or the Protocols thereto, and if the internal law of the High Contracting Party concerned allows only partial reparation to be made, the Court shall, if necessary, afford just satisfaction to the injured party. »The principle of indemnisation derives from international law cases which constraints the State failing to fulfil its international commitments to remove retroactively the consequences of the…

Illuminismo e giustizia penale. Il caso della ghigliottina

2011

International audience; A mechanical daughter of the enlightenment, the guillotine remains a frightening symbol of its dialectic. Being one of the most troubling inventions of utilitarian rationalism in modern europe, it meets the expectations of equality, secularism, and humanity of the legal culture of Philosophes. Focusing on the texts and contexts of the institution of this lethal machine in the administration of justice, this article examines the anthropological sense and the political dimension of the recourse to the machine. Is the mechanization of capital punishment a step forward in the humanization of social relations or the entry in the era of technical inhumanity? In this ambigu…
