Human rights-based national climate litigation is a growing phenomenon. In Europe, this type of litigation is essentially based on the case law of the European Court of Human Rights, whose human rights obligations are used as a means of interpreting climate obligations of States towards their citizens. The analysis of domestic jurisprudence produces a complex picture. On the one hand, we find elements facilitating access to environmental justice, such as more flexible eligibility criteria and the issuing of immediately enforceable judgments. Il contributo introduce lo special Issue "Il lato oscuro del diritto nella criminalizzazione del soccorso in mare" sottolineando come le ricostruzioni e le riflessioni poste in essere in questa raccolta di contributi possano almeno contribuire a descrivere le dinamiche e a porre in evidenza i pericoli intrinseci nello spazio di arbitrio che il lato oscuro del diritto schiude. Which Foundation for Human Rights?

The article argues the thesis according to which the problem of the foundation of human rights is not well formulated in the classic debate on it. The reason is that there are different kinds of foundations, depending on the different concepts of human rights, but also in consideration of the different aspects of their practice. The question is then which foundation fits with a notion of human rights as a legal and social practice. The second part is dedicated to the analysis of the idea that the practice of human rights is part of the current jus gentium. It aims at showing the implications of that relationship in terms of their appropriate legal grounds.
