This study in comparative physical education examines the curricula followed by physical-education teachers in China and France. It explores how theories of physical education and sport in each country have developed out of specific political, cultural and educational contexts, yet resulted in strong similarities in terms of the priority given to training programs. At least three powerful arguments are provided in support of that view. First, to claim that, at the same time as they play, players can change the rules is, to say the least, logically puzzling. The paper is concerned with what Albert Breton, in his theory of competitive federalism has called vertical competition, that is, competition between governments situated at different levels. However its setting is government systems that are unitary rather than federal and structured around three or four levels of government rather than the two often implicitly assumed. The paper tries to show that these characteristics may offer a partial solution to what is perhaps the major problem raised by vertical competition, that is, how winners in a vertical contest get protected against retaliation by the losers when the latter can change the rules (which are not constitutionally entrenched). Jean-Louis Halpérin, Private Law and the Revolution : Legislative Heritage and Ideological Heritage. The private law of the French Revolution is to-day no longer considered an intermediary law. Yet from a positivist point of view, most of the provisions enacted in this area between 1788 to 1799 were of short duration. Indeed, a large part of revolutionary private law is made up of bills and drafts which were never implemented. This singularity invites us to ponder the legal ideological nature of a law which barely left the drawing-board and its impact in France and abroad.
