Available Defences for Defendants in the Provisional Measures in Europe: Between Theory and Practice

2014

The EU Enforcement Directive provides a set of provisional measures to be applied by a request of a right-holder of a particular object of intellectual property. Simultaneously, the EU Enforcement Directive envisages a set of defences for an alleged infringer in order to safeguard the balance of parties. This article discusses available defences for an alleged infringer in provisional measures as provided by the EU Member States when norms of the EU Enforcement Directive are transposed in conjuncture with the available court practice. Specifically, the present article focuses not only on the threshold of evidence to be presented by a plaintiff for application of provisional measures but als…

Available Defences in Provisional measures: Between the Enforcement Directive and National law

2015

AbstractThe EU Enforcement Directive provides a set of provisional measures to be applied upon request from a right-holder of a particular object of intellectual property. Simultaneously, the EU Enforcement Directive envisages a set of defences for an alleged infringer (defendant) in order to safeguard the balance of the parties. This article discusses available defences for an alleged infringer in the provisional measures as provided by the EU Member States when the norms of the EU Enforcement Directive are transposed. Specifically, the present article not only focuses on the threshold of evidence to be presented by a plaintiff for the application of provisional measures, but also in regar…

Peter Olivi on Political Power, Will, and Human Agency

2016

This essay discusses the views of Peter Olivi (ca. 1248-98) on the foundations of political power and agency. The central argument is that there is a strong connection between Olivi’s voluntarist psychology and his views concerning political power. According to Olivi, political power is ultimately based on the will of God, but in such a way that both the rulers and their subjects have, through their individual freedom, the liberty to use their share of power as they will. In fact, Olivi conceptualises political power as an extension of the dominion that human beings have over their wills, which is essential for being a political agent in the full sense. By providing a philosophical analysis…

Hans Kelsen and Practical Reason

2017

The critique of practical reason, in all its possible forms, has a far more important and decisive role in Kelsen’s thought than the rejection of Natural law doctrine. Admitting that a practical use of reason is legitimate, namely, that there is a possible connection between intellect and will, would mean destroying the whole foundation of the scientific undertaking of the Pure Theory of law and its conception of the legal norm, which is its central aspect. By depriving practical reason of all foundation, any reference to agency and practical deliberation is excluded from Kelsen’s theory of law. Consequently, the Ought loses all capacity of attraction and motivation of human action, renderi…

‘I Got To Answer the Way I Wanted To’: Intellectual Disabilities and Participation in Technology Design Activities

2021

User involvement in technology design processes can have positive implications for the designed service, but less is known about how such participation affects people with intellectual disabilities. We explored how 13 individuals with intellectual disabilities experienced participation in the design of a transport support application. The study is based on qualitative interviews, photovoice interviews, participant observations, and Smileyometer ratings. A thematic analysis generated the following themes: a sense of pride and ownership, an experience of socialization, and a sense of empowerment. The findings suggest that participation in design activities is a primarily positive experience t…

Genome-wide variant calling in reanalysis of exome sequencing data uncovered a pathogenic TUBB3 variant.

2021

Almost half of all individuals affected by intellectual disability (ID) remain undiagnosed. In the Solve-RD project, exome sequencing (ES) datasets from unresolved individuals with (syndromic) ID (n = 1,472 probands) are systematically reanalyzed, starting from raw sequencing files, followed by genome-wide variant calling and new data interpretation. This strategy led to the identification of a disease-causing de novo missense variant in TUBB3 in a girl with severe developmental delay, secondary microcephaly, brain imaging abnormalities, high hypermetropia, strabismus and short stature. Interestingly, the TUBB3 variant could only be identified through reanalysis of ES data using a genome-wi…
