From Ethnic Law to Town Law: The Customs of the Kingdom of Sicily from the Twelfth to the Fifteenth Century

The history of Sicily, the largest island of the Mediterranean, is notably distinct from the history of the rest of Italy. It is because of this distinctiveness that Sicily can serve as a paradigmatic example of a pluralist legal system, one with a mix of both personal-law and territorial-law rules. In the time period that I examine in this essay, customary law took several different forms. What legislation, private records, and judicial decisions all call »custom« plays three different roles: law of specific ethnic groups, rights and customary practices concerning real property, and the law of towns.

Deliberative democracy and the European Convention on Human Rights Theories of deliberative democracy have rapidly become very popular amongst political scientists. The central argument of these theories is that democratic legitimacy of lawmaking does not lie (or does not only lie) in the elected character of Parliaments but in public delib- eration processes. Se estudian, de un lado, aquellos que protegen este derecho a través de la vía de la interrelación con otros derechos, como es el caso del Tribunal Europeo de Derechos Humanos o del sistema interamericano. Alcune riflessioni sull’indipendenza giudiziaria nel contesto europeo

This article aims to provide some reflections on the links between judiciary independence, the rule of law, and the role of judges both national and European. First of all, it focuses on the evolution of the role of the judge in the constitutional and European systems. Then, it shows how the European Court of Justice and the European Court of Human Rights have developed criteria to ensure the independence of judges, analysing them. Moreover, it examines the criteria that have been developed by the European courts and by the opinions of the Consultative Council of European Judges about the independence of the Judiciary Councils.
