The Myth of French Influence Over Spanish Codification: The General Part of the Criminal Codes of 1822 and 1848

The chapter aims to explore the scope of the foreign influences, that of the French in particular, in the criminal codes of 1822 and 1848/50. In doing so, the author departs from the views of some 19th century criminal lawyers who, like J. F. Pacheco, stated that in the old criminal laws “nothing was worthy of respect, or conservation” and “there was only one legitimate and viable system, the system of codification, the system of absolute change,” and recognizing that drafters were fully acquainted with the case of France, a jurisdiction that managed to turn its old laws—including the criminal ones—into modern codes (1804–1811). In 1640 Anna, the daughter of the prince of Valdina, was forced to live in a convent (for patrimonial reasons) in Palermo along with three sisters. She was seven years old and remained there until 1699. First she asked her father and then her brother to leave the monastic life that she never accepted. Her story is inscribed within the phenomenon of the so-called "forced monachizations ", to which the Council of Trent had tried to remedy for. Building on the report on gaps in international environmental law prepared in 2018 by the UN Secretary-General, this chapter focuses on the existing gaps in international biodiversity law and explores possible ways forward to a more effective and integrated legal regime. Incentives, criminal defence lawyers and plea bargaining

Plea bargaining has become a central feature of criminal procedure in Anglo-Saxon jurisdictions. This paper explores an area seldom discussed in the economic literature on plea bargaining: the influence of the defence lawyer's fee contract on the terms of the bargain. In particular, it uses data from one jurisdiction of the impact on case trajectories of changes in publicly funded defence lawyers’ contracts to test the proposition that the nature of the lawyer's contract influences how cases are managed. The essay critically analyses the consolidated orientation of the Court of Cassation according to which the consumer legislation is not applicable to professionals who make a contract for the purchase of goods and services that they will use to work. For example, lawyers do not only stipulate mandates or make consultancy contracts with their clients, but also make all the contracts that are necessary or useful for the fulfillment of their professional practice; these acts may include the purchase of legal texts and professional indemnity insurance, or the supply of cleaning, electricity, gas and telephone services for their legal firms.
