Moving from some perspectives of investigation emerged during the Roman law Seminar on ‘Orizzonti della critica testuale fra tradizione e nuovi indirizzi’, held in Palermo (16 november 2018), the A. examines a ‘comparison’ between texts, respectively, of Justinian’s Institutes and Digest [I. 2.11.5 = Marc. 4 inst. D. 29.1.22], analyzed by Lauro Chiazzese in the manuscript discovered and recently published by Giuseppe Falcone [Confronti testuali. The prohibition of commentaries to the Digest and the antecessorial literature

Esaminate e criticate le diverse interpretazioni presenti in storiografia, si propone una nuova lettura del divieto giustinianeo di commentari al Digesto, che postula il divieto come avente ad oggetto il Digesto quale testo da usare nei tribunali e non quale testo oggetto di studio. Conseguentemente, i destinatari del divieto non erano gli antecessores, come finora unanimemente ritenuto: il che rende perfettamente giustificabile e non in contrasto col divieto la presenza di una ricca produzione di commentari derivanti dall'attività di insegnamento.

Among the problems long debated by the scholars of the Greek Paraphrase of Justinian’s Institutes, the most interesting was the one concerning the legal sources used by Theophilus; they indeed are not identical with Justinian’s Institutes. Furthermore, a point of view prevails that claims the Antecessor – during the editing of his Paraphrase – could also have taken into consideration Gaius’ Institutes. J.C. Maier – ein bereits bekannter Helfer Bluhmes bei der Transkription des Veroneser Codex Iustinianus

J.C. Maier – a previously known aide to Bluhme in the transcription of the Veronese palimpsest of Justinian’s Code. This paper calls into question the idea that in the summer of 1823 Maier worked together with Bluhme at the decipherment of the palimpsest of Gaius’ Institutes preserved in the Capitular Library of Verona (Verona, B. Cap., Cod. XV). A comprehensive analysis of the sources leads to the conclusion that Maier helped Bluhme in the same library for the transcription of the palimpsest of Justinians’ Code (Verona, B.
