2019

Moving from some perspectives of investigation emerged during the Roman law Seminar on ‘Orizzonti della critica testuale fra tradizione e nuovi indirizzi’, held in Palermo (16 november 2018), the A. examines a ‘comparison’ between texts, respectively, of Justinian’s Institutes and Digest [I. 2.11.5 = Marc. 4 inst. D. 29.1.22], analyzed by Lauro Chiazzese in the manuscript discovered and recently published by Giuseppe Falcone [Confronti testuali.

The prohibition of commentaries to the Digest and the antecessorial literature

2014

The ὅρος ἤτοι ἐτυμολογία of testamentum and the problem of sources in the Paraphrase of Theophilus

2014

Among the problems long debated by the scholars of the Greek Paraphrase of Justinian’s Institutes, the most interesting was the one concerning the legal sources used by Theophilus; they indeed are not identical with Justinian’s Institutes. Furthermore, a point of view prevails that claims the Antecessor – during the editing of his Paraphrase – could also have taken into consideration Gaius’ Institutes. My speech is based on a close analysis of a well-known passage (Theoph. 2,10 pr. concerning the definition or etymology, ὅρος ἤτοι ἐτυμολογία, of testamentum) and it aims to re-examine how Theophilus managed his sources. The content of the principium is far wider and better articulated compar…

2019

Many bridges built in the ancient Rome have survived to the present time. In this presentation, the author does not focus his attention on the architectural, archaeological, construction or statistical aspects. He discusses, above all, the legal regulations concerning the bridges in the Justinian's legislation. He is looking for an answer to the question of who in the ancient times at the Romans’ supervised the bridges. He wonders if the curatores pontis existed? It touches on the question of building a "private" bridge, the correlation of bridge issues and servitude, the bridge versus assassination, the bridge versus a suicide or the bridge versus taxes paid by the Church. The Romans did n…

2018

J.C. Maier – a previously known aide to Bluhme in the transcription of the Veronese palimpsest of Justinian’s Code. This paper calls into question the idea that in the summer of 1823 Maier worked together with Bluhme at the decipherment of the palimpsest of Gaius’ Institutes preserved in the Capitular Library of Verona (Verona, B. Cap., Cod. XV). A comprehensive analysis of the sources leads to the conclusion that Maier helped Bluhme in the same library for the transcription of the palimpsest of Justinians’ Code (Verona, B. Cap., Cod. LX). – Keywords: Bluhme; Maier; Gaius’ Institutes; Verona, B. Cap., Cod. XV; Codex Iustinianus; Verona, B. Cap., Cod. LX; manuscript studies.

Law, Politics, and Religion in Justinian Legislation

2022

An analysis of the ideological, political and religious motives which brought to life Justian legislation, in which Roman law and the Orthodox Catholic religion converge, helps to understand the reasons that led the Byzantine emperor to legitimize his imperial power using it as a powerful instrument of intolerance and discrimination towards those in opposition to him.
