George Tsebelis distinguished two forms of veto players’ actions: institutional and partisan. In a democracy, the Church is not able to play either role because it is not an element of the state’s institutional structure. This was the source for Simon Fink’s proposal to look at the Church as a societal veto player (VP). The case of Poland shows, however, that such an approach becomes inadequate in numerous situations. This chapter clarifies the new concept of cosmopolitanism as nonrelationism and embeds it in the academic debate. In defence of the new concept, it clarifies how personal relationships can be valued without treating them as a basis for justifying special responsibilities between related individuals. The argument distinguishes between different kinds of responsibilities based on a responsibility framework developed from conceptual considerations of Hart and O’Neill as well as Pettit and Goodin. It reveals that not all kinds of responsibilities are equally relevant with regard to matters of justice.

Intellectual property from a labour law perspective: the transfer of authors' rights in labour relationships

This article analyses Spanish intellectual property law to establish whether formalised employment contracts are associated with the transfer to employers of the economic rights to works created by employees. This analysis is limited to the legal treatment of employee-created literary, artistic and scientific works, which are subject to authors' rights and are protected by intellectual property law. The study does not include inventions created in a labour relationship, which are regulated by legislation on patents and brands, and are thus dealt with differently according to industrial property rights.

This paper deals with the presumption of innocence and the law enforcer's incentives to exert investigative effort. Our main result is that, even if the presumption of guilt maximizes deterrence for a given effort by the law enforcer, divergent objectives between the law enforcer (who maximizes the probability of a conviction weighted by the magnitude of the sanction and the type of the citizen) and the public decision-maker (who minimizes social costs) may lead the latter to prefer the presumption of innocence. PD EIO could mark a turning point in the development of “European criminal procedure.” The Proposal will obtain evidence in cross-border cases and is particularly suitable for investigations on the subject of international organized crime. From the long gestation period and the contents of the Proposal emerges, however, the difficulty of making a balance between the investigation of crimes and the guarantees of the individuals involved. The use of collected of evidence from different legal systems is often an overly neglected aspect. Doubt surrounds the regulation of banking instruments, the rules on wiretapping, and all provisions for undercover investigations.
