Not Quite Final: Principle of Res Judicata in National Judicial Proceedings in the Area of State Aid

This article addresses the principle of res judicata in the context of rules on State aid, including the case-law of the Court of Justice and the 2021 Commission Notice on the enforcement of State aid rules by national courts. The limits of the principle at issue required by Article 108(3) TFEU and the powers of national courts to recover unlawful aid (with or without a recovery decision from the Commission) are discussed. The law is stated as it stood on 1 January 2022 (with some later developments). Nematode parasite species belonging to the Anisakis simplex complex are the most important cause of human anisakiasis through the consumption of (mainly) undercooked, previously not frozen, or conveniently treated fish. Myosporidium ladogensis n. comb. in burbot Lota lota from Finland: fine structure and microsporidian taxonomy.

Infections with microsporidian parasites are described in skeletal muscle of burbot Lota lota from Lake Haukivesi, Finland. Infected myocytes contained spores within sporophorous vesicles (SPVs) in contact with host cell cytoplasm, similar to Pleistophora ladogensis in L. lota and smelt Osmerus eperlanus in western Russia and northern Germany. Analysis of small subunit ribosomal RNA (SSU rRNA) gene sequences indicated identity with Myosporidium spraguei in burbot and pike-perch from this lake. Aporocotyle mariachristinae n. sp. and A. ymakara Villalba & Fernández, 1986 were collected from the bulbus arteriosus and ventral aorta of pink cusk-eels, Genypterus blacodes (Forster, 1801) from Patagonia, Argentina. A. mariachristinae n. sp. can be distinguished from all the species of Aporocotyle by the asymmetrical extension of posterior caeca (right posterior caecum longer, terminating at the area between mid-level of ovary and posterior body end; left posterior caecum shorter, terminating at the area between mid-level of cirrus sac and posterior to reproductive organs), the distribution of spines along the ventro-lateral body margins and the number of testes. In this study the chemical composition of the essential oil from aerial parts of Moluccella spinosa L. collected in Sicily was evaluated by GC and GC-MS. The main components of M. spinosa L. were α-pinene (26.6%), caryophyllene oxide (16.8%) and β-caryophyllene (8.6%). A comparison with other studied oils of genus Moluccella is made. Antibacterial and antifungal activities against some microorganisms infesting historical textiles were also determined.

Michele Vella, sculptor and antiquarian of Agrigento, born in nearby Raffadali, is known through chronicles and accounts of foreign travelers who visited "the city of temples" duringin the last few decades of the eighteenth century. Prior to devote himself to the study of ancient Agrigento and to become a "guide" of famous visitors, such as Goethe, he began to develop a treatise on architecture dedicated in 1766 to the bishop Andrea Lucchesi Palli. The unfinished manuscript titled Vari Componimenti d'Architettura is now located at the Library Lucchesiana of Agrigento.

Abstract This paper discusses the Middle Neolithic and the Early Bronze Age phases of the occupation of a rock shelter at Vallone Inferno (Scillato, Palermo) in Sicily. Vallone Inferno is a key site for studying the early establishment and development of pastoralism in the prehistoric mountainous environments of Sicily. Seasonal use of the site as a shelter is documented for the earliest pastoral communities that exploited the Madonie mountain range. The results of the analysis of pottery and lithic assemblages contribute to the definition of two chronocultural frameworks that were linked by the same economic subsistence base.
